المستخلص: The Algerian legislator gave the partner in the common property the right to dispose of his common share in all types of conduct, provided that it did not harm other partners' rights, as provided for in article 714 of the Civil Code.
If the partner happens to dispose of his share that he sold to a foreigner by mutual consent, this would indicate the existence of damage caused to the rest of the partners. For this purpose, the legislator regulates the right to restitution, i.e., recovery of the common share sold in Article 721 as a means of lifting the damage to the other partners, in accordance with the conditions and procedures stipulated in the law.

أعطى المشرع الجزائري للشريك في الملكية الشائعة الحق في التصرف في حصته الشائعة بكل أنواع التصرفات شريطة أن لا يلحق ضرراً بحقوق باقي الشركاء ونص على ذلك في المادة 714 من القانون المدني.
فإذا حدث وأن تصرف الشريك في حصته بأن باعها لأجنبي عن طريق التراضي فهذا يدل على وجود ضرر قد لحق باقي الشركاء، من أجل هذا نظم المشرع حق الاسترداد أي استرداد الحصة الشائعة المبيعة في المادة 721 كوسيلة من وسائل رفع الضرر عن باقي الشركاء، وذلك وفق شروط وإجراءات نص عليها القانون.


Le législateur algérien a donné à l'associé à la propriété indivise le droit d'en disposer de sa quote- part indivise de toutes les qualités des actes, pourvu qu'il ne porte pas préjudice aux droits des autres co-indivisaires, comme il est indiqué à l'article 714 du code civil.
En cas ou l'associé vend à l'amiable sa part à un tiers, donc il ya préjudice qui touche les restes associés.
Pour cela, le législateur a organisé le droit de retrait selon l'article 721 du code civil, et ce, suivant aux conditions et procédures indiquées à la loi.
