|a أيما قاعدة قانونية تظهر إلى الوجود القانوني لا تكون فعالة ما لم تكن مقرونة بجزاء، وعلى اعتبار أن البيئة التي نعيش فيها بكل ما تزخر به من مسخرات، تعرضت عبر الأزمنة إلى انتهاكات صارخة من قبل الإنسان، وصلت إلى أوجها، وأصبحت تنذر بخطر حقيقي وليس بخطر وشيك الوقوع، مما استدعى ضرورة حظر هذه الانتهاكات بتسليط جزاءات مختلفة على مقترفيها، وكذا اتخاذ التدابير اللازمة من أجل استدراك هذا الخطر قبل استفحاله، وهو الأمر الذي استمال اهتمام المشرع الدولي كما الجزائري، الذي عمل على حماية هذا الموروث من خلال ترسانة القانونية عالجت جميع المواضيع المتعلقة بالبيئة، مسايرا بذلك الاتفاقيات الدولية التي انعقدت بمناسبة التغيرات البيئية المفاجئة، والحفاظ على الموارد الطبيعية للأجيال المستقبلية قبل استنفاذها بطرق عشوائية.

|f Whatever a legal rule that comes into legal existence would not be effective unless a sanction accompanies it. Considering that the environment in which we live, with all its harnesses, has been subjected throughout times to blatant violations by man, it has thus reached its peak and has become a real danger rather than an imminent danger. This necessitated the need to prohibit these violations by imposing various sanctions on the perpetrators and taking the necessary measures to remedy this threat before it escalates. This has attracted the attention of the international legislator, as well as the Algerian, who has worked to protect this legacy through a legal arsenal that dealt with all issues relating to the environment in line with international conventions that were held on sudden environmental changes and the conservation of natural resources for future generations before they are indiscriminately depleted.\nThis abstract translated by Dar AlMandumah Inc. 2020
