المستخلص: لمباحث الاجتهاد أهمية عظيمة في الشرع، ومنزلته في نفوس العلماء كبيرة، لأنه من أهم الوسائل التي يتمكن بها العالم المختص من التوصل إلى الأحكام الشرعية في مسائل الحياة المتجددة، فكان لابد من وجود فئة متخصصة في العلوم الشرعية وما يتصل بها، تتولى مهمة النظر في القضايا المستجدة وبيان الأحكام الشرعية المناسبة لكل منها بحيث يسهل الرجوع إليها، والاستئناس بها، وإعمال الفكر في نصوص الكتاب والسنة وسيلة للتعرف على الأحكام غير المنصوص عليها، وكان الاجتهاد طريقا لازما للوقوف على مقاصد الشريعة وسبيل من سبل الحفاظ على خلودها ولتحقيق ما يعين للناس من أمور استجدت في الحياة. والتجديد: الذي ندعو إليه لا يعني طرح المساس بالثوابت القطعية وإيجاد أخرى غريبة ودخيلة، وإنما هو إدخال تعديلات في التكوينات الفرعية للكيان العام، فالتجديد يعني تعديل أوضاع وتغير علاقات وإدخال مستجدات، ولكن بما يتقبله الكيان العام ولا يلفظه، ويتلائم معه ولا يرفضه، إذ التجديد إصلاح للكيان لا إفساد للتكوين. والفتوى: فريضة شرعية وإحدى الوسائل الأساسية لتعليم الناس الشرع وتبليغهم الأحكام الشرعية وتبصيرهم بالدين ولقد تعرضت الفتوى في القديم إلى إشكاليات كثيرة ومشاكل متعددة، ولكن ظهرت في الوقت الحاضر بشكل متفاقم وكثيف، ودار الزمان دورته، وابتعد معظم الناس عن مظلة الخوف من الله، وخرج من يفتي بفتاوى ما أنزل الله بها من سلطان فظهرت الإشكاليات، وهي الالتباسات التي تقع في الفهم أو الطريقة حتى ضج الناس والعلماء من هذا الأمر ووقع الناس في التباسات وانقسامات وحتى وصل الأمر إلى اتهام العلماء بحق أو دون وجه حق مما أدى إلى إيجاد أحكام شرعية غير صحيحة وهذا من أخطر أمور الفتوى في عصرنا الحاضر، وقد أفرز ذلك من يعيش على طرفي نقيض: من يحرم ويكفر مخطئا في فهم ما كان عليه العهد الأول، وفي الطرف الآخر من ينادي بالتحلل والتيسير في كل شيء، حتى لو أدى ذلك إلى تمزيق الثوابت.
