المستخلص: موضوع البحث: حدود الطاعة الزوجية في المسائل الفقهية الخلافية "دراسة تأصيلية تطبيقية" مشكلة الدراسة: اختلاف الزوجين المتكرر في المسائل الفقهية الخلافية، واعتقاد كل منهما صحة رأيه؛ مما أصبح مصدر خوف وقلق عند بعض الأزواج. وهدفها: أن تكون سببًا في تخفيف ما قد ينشأ من نزاع بين الزوجين بسبب الاختلافات الفقهية، من خلال البحث عن مخرج شرعي؛ للتوفيق بينهما، ومراعاة مصلحتهما. حدود البحث: إذا اعتقد الزوجان أو أحدهما بطريق شرعي صحيح، في حكم فقهي ما، معتقداً يختلف عن معتقد صاحبه، مع بيان كيفية تعاملهما مع هذا الاختلاف عند وقوعه. منهج البحث: المنهج التأصيلي التطبيقي التحليلي المقارن. نتائج الدراسة: أنّ العشرة بالمعروف واجبة على الزوجين معًا، وان كانت طاعة الزوج أوجب، وحقّه أعظم، وأن عليهما أن يراعيا في كل خلاف بينهما فقه الموازنات والمآلات؛ وأن مصلحة دوام العشرة واستقرارها أولوية تجب المحافظة عليها.

Research Subject : Conjugal obedience limits at the jurisprudential moral matters "Applied Fundamentalist Study " Study Problem : Repetitive disagreement marrying couple at the jurisprudential moral Matters and the each convinced of the veracity of his opinion to the effect that it turned out to be source of fear and anxiousness for some marrying couples. Study Objective This study should be a factor for mitigate the disagreement between the marrying couple concerning the jurisprudential differences by means of searching for legitimate solution as a conciliatory means between them and in consideration of their interests. Research Limits : If it happened that marrying couple or one of them thought legitimately and rightly in terms of sound sense or emulation at jurisprudential ruling to the inference of a thought differs from the one 's though creator other than that stipulated at the contract, this difference should be sought in terms of how it is tackled in their own discretion immediately if occurred. Research Methodology Fundamentalist, applied analytical and comparative approach Study Findings Living amicably is an asset for the marrying couple given preference to the axiom that the wife's obedience to her husband is a must and superior right to the effect that they both should consider the disagreement erupted between them to the consideration as a paramount importance the lasting living and stability ate priorities which should be maintained.
