المستخلص: The research focuses on one of the important topics of the science of the fundamentals of Islamic jurisprudence, that is, the methodologies of the scholars of Usuul in studying the topics of discrepancy and weighting, an analytical and critical study. The problems of the study focused on investigating the methodologies of the scholars of Usuul in studying issues of discrepancy and weighting, and presenting and criticizing it in a way that clarifies way of the scholars of Usuul in relating with this important component of the science of Usuul, and that there is a clear of difference in the methodology of arranging and presenting the topics of discrepancy and weighing in a way that shows the format and methodological difference in their presentation. The researcher used inductive, descriptive, analytic deductive method in studying the topic. The researcher divided the topic of the research in to five sections. The first one deals with the definition of discrepancy and weighting in addition to identifying the schools of thought in the science of Usuul. The second section includes the methodology of Imam Ash-Shaafi'i in handling the topics of discrepancy and weighting. In the third section, the researcher discussed the methodology of the theologists in handling issues of discrepancy and weighting. The fourth section deals with the methodology of the Hanafis in handling issues of discrepancy and weighting. The fifth section deals with the methodology of the combined school of thought in handling issues of discrepancy and weighting. In the sixth section, the researcher studied the methodology of the contemporary scholars in handling issues of discrepancy and weighting. The researcher concluded some important findings regarding the foregoing topic, they could be summarized as follows: That great efforts have been garnered towards arranging and discussing issues of discrepancy and weighting. And that these methodologies varied according to the nature to each Usuul school of thought and this led to a format and logical juristic effort regarding the subject, This shows the mental and thought richness that distinguished the scholars of Usuul on this topic. The researcher recommends that this topic should further be studied in a more elaborate and scholarly way as it deserves more research, investigation and study and this shall facilitate the easiness of comprehending the structure of issues of discrepancy and weighting for the researchers and students, and will help in making it easy for them to benefit.

يتضمن البحث موضوعا مهما من موضوعات علم أصول الفقه الإسلامي، وهو مناهج الأصوليين في تناول موضوعات التعارض والترجيح دراسة وصفية نقدية، حيث تركزت مشكلة الدراسة في استقراء مناهج الأصوليين في تناول موضوعات التعارض والترجيح، وعرضها، ونقدها على نحو يبين كيفية صنيع الأصوليين في التعامل مع هذا القطب المهم من أقطاب علم الأصول، وأن هناك اختلافا منهجيا واضحا في ترتيب وعرض موضوعات التعارض والترجيح، على نحو يبين الفروقات الشكلية والمنهجية في عرضها. وقد استخدمت الباحثة المنهج الاستقرائي الوصفي التحليلي الاستنتاجي في دراسة هذا الموضوع، وقد قسمت الباحثة موضوع البحث إلى ستة مباحث تناولت في المبحث الأول: تعريف التعارض والترجيح والتعريف بالمدارس الأصولية، وفي المبحث الثاني: منهج الإمام الشافعي في تناول موضوعات التعارض والترجيح، وفي المبحث الثالث: منهج المتكلمين في تناول موضوعات التعارض والترجيح، وفي المبحث الرابع: منهج الحنفية في تناول موضوعات التعارض والترجيح، وفي المبحث الخامس: منهج المدرسة الجامعة في تناول موضوعات التعارض والترجيح، وفي المبحث السادس: منهج المعاصرين في تناول موضوعات التعارض والترجيح. وقد توصلت الباحثة إلى جملة نتائج مهمة في سياق البحث، وحاصلها: أن هناك جهدا أصوليا كبيرا وضخما بذل في تنظيم وتناول موضوعات التعارض والترجيح، وقد تباينت هذه المناهج وفق طبيعة كل مدرسة من المدارس الأصولية، مما أورث اجتهادا شكليا ومضمونيا في تناول موضوعي التعارض والترجيح، مما يبين الثراء الفكري والعقلي الذي تميز به الأصوليون في هذا الموضوع، وتوصي الباحثة تناول هذا الموضوع في دراسة علمية موسعة لأنه يستحق مزيدا من البحث والتدقيق والتحقيق مما يسهل على الباحثين والدارسين خريطة موضوعات التعارض والترجيح، ويسهل عليهم الاستفادة منها.
