المستخلص: القضايا المعاصرة – التي تتطلب بيان حكم الله فيها: هي القضايا المستجدة التي طرأت على الناس في العصر الحاضر، ولم تكن معروفة في العصور السابقة، وكذلك القضايا التي عرفت في الماضي، وحكم فيها بحكم ولكن موجب هذا الحكم تغير لتغير الظروف والأحوال، فوجب إعادة النظر في تلك القضايا، كما ينطبق مفهوم القضايا المعاصرة على القضايا المركبة من عدة صور قديمة. والفتوي من الأعمال الدينية الجليلة، والمهام الشرعية الجسيمة، ينوب فيها الشخص بالتبليغ عن رب العالمين، ويؤتمن على شرعه ودينه، والمفتي قائم في الأمة مقام النبي صلى الله عليه وسلم، فهو مخبر عن الله تعالى كالنبي، لذلك يجب أن يكون المتصدي للفتوى مؤهلا؛ حتى يقوم بها خير قيام، وأهم ما يجب أن يتأهل به المفتي: هو الاستقامة على دين الله، والعلم بالأحكام الشرعية، والتحلي بالآداب والصفات التي تقوده إلى مرضاة الله وتوفيقه، وتجعل فتواه سليمة ومقبولة عند الله وعند الناس. ويجب على المفتي أن يسير في فتواه وفق منهجية منضبطة في فهم الواقعة المعروضة عليه، وفي فهم الحكم الشرعي الذي يجب إنزاله على تلك الواقعة. كما يلزمه أن يحرص على التيسير في الفتوي؛ مراعاة لحال المستفتي وتسهيلا له في تطبيق الأحكام، وليس المقصود بالتيسير: الإتيان بشرع جديد، أو إسقاط ما فرض الله، وإنما المقصود بالتيسير: الوسطية في الفتوي، وتقديم الأيسر على الأحوط، والتيسير فيما تعم به البلوى، ومراعاة الرخص، والتحري، وعدم التوسع في تكليف الناس بالأحكام بدون دليل صريح يقضي بذلك. على المفتي أن يراعي في فتواه مصالح الناس وأحوالهم، ملتزما في ذلك بما ترشد إليه نصوص الكتاب والسنة، وأبرز المصالح التي ينبغي مراعاتها المصالح المتغيرة، والمصالح المستجدة، وضرورات العصر وحاجاته، وما اقتضاه التطور العلمي. ينبغي للمفتي في القضايا المعاصرة أن لا يتقيد في فتواه بمذهب معين وإنما يأخذ من أقوال العلماء ما كان أرجح دليلا، وأكثر تحقيقا لمقاصد الشريعة، ورعاية مصالح الناس والتيسير عليهم. ينبغي أن تكون الفتوي في القضايا المعاصرة جماعية، وذلك بأن يبين العلماء حكم الواقعة بعد تشاورهم في الأمر من خلال المؤسسات أو المجالس أو الهيئات أو المجامع التي تنظم تجمع العلماء وممارستهم لأعمالهم في الاجتهاد والفتوي.

The contemporary cases which require clarification of Allah’s rulings, are those new issues which happened in this age and were not known before, or those which were known before and received some ruling but the basis of that ruling has changed due to the change of circumstances, therefore, there is necessity to revisit them. The concept of contemporary cases could also be applied to those cases composed of old parts. The Fatwa is one of the most respectable religious tasks, because the Mufti is issuing a ruling in the name of Allah (SWT), is entrusted with His religion and Sharia and is doing the job of the Prophet Muhammad (pbuh) in conveying Allah’s Message; therefore, whoever is assuming the office of Mufti must be well qualified so as to render his job in the best way. On the top of the Mufti’s qualifications come the following: commitment to The Deen of Allah, sufficient knowledge of the Sharia rulings, being marked by good manners and characteristics that make him eligible to attain the pleasure of Allah (SWT) and his fatwas be accepted by Allah and by people too. In his fatwas, the Mufti must follow a clear and accurate methodology in understanding the case presented to him and in understanding the suitable Sharia ruling to be applied to that case. The Mufti must seek easiness in his fatwas taking into consideration the fatwa seeker’s conditions. Seeking easiness does not mean to changing the Sharia or dropping Allah s prescriptions, but to be moderate, preferring the easier to the precautious, particularly in the problems affecting the mass, using licenses and being very carefully restrictive not to prescribe upon Muslims duties without clear evidence necessitating them. The Mufti must observe people’s interests and conditions abiding by the guidance of the Qur’an and Sunnah. The most prominent interests to be considered are those changing and the new ones as a result of the requirements of the time and the scientific developments. The Mufti, in his fatwas on the current issues, must not be restricted to a specific Fiqh madhhab; rather he is strongly urged to rely upon different scholars’ views that are more weighing and better serving the aims of Sharia, people’s interests and the principle of easiness. The fatwas on the contemporary issues are better be collective through joint efforts and consultations of groups of scholars organized by councils, corporations or academies.
