المستخلص: من يتأمل أحكام الإسلام وتاريخ المسلمين يجد أنه لا يمكن أن يقوم مجتمع تحترم فيه الحقوق والواجبات كما في دولة الإسلام، فغير المسلمين كانوا يتبوءون أعلى المناصب سواء في الطب أو الهندسة أو حتى في السياسة وغيرها، وما كان لمثل هؤلاء أن يظهروا أو ينبغوا لولا سماحة الإسلام وتعايشه مع غير المسلمين، وهذه المبادئ الراقية جعلت من الإسلام دينا عالميا صالحا لكل زمان ومكان، ودخل في قلوب الناس، حيث لم يستطيعوا مدافعته لصلاحه وبساطته وصدقه وشموله. ويهدف البحث إلى معالجة هذه القضية بموضوعية واعتدال. وقد اعتمدت على: 1- المنهج التحليلي: وذلك من خلال تحليل النصوص ومحاولة استنباط قواعد عامة حول الحقوق المتعلقة بغير المسلمين. 2- منهج المقارنة: من خلال توضيح فقه الخلاف في عرض المسائل المختلف فيها. 3- المنهج النقدي: من خلال استخدامه في نقد الآراء الشاذة والضعيفة وكان من أهم نتائج البحث: 1- تؤكد نصوص الكتاب والسنة وجوب الإحسان إلى غير المسلمين في المجتمع الإسلامي والبر بهم وحرمة إيذائهم في أنفسهم وأموالهم وأعراضهم. 2- يعتبر خلق المساواة والتسامح مع غير المسلمين خلقا أصيلا ينبثق من إيمان المسلم وعقيدته

Islam is the religion of forgiveness and co-existence. Whoever contemplates the rules of Islam and the history of Muslims finds that you can never find a society in which rights and duties are respected like the Islamic society. In the Islamic society, non-Muslims have ascended the highest positions in medicine, geometry, or even in politics, etc.; such people could not have been elevated without the forgiveness and co-existence of Islam with non-Muslims. These moral principles have allowed Islam to be a global religion that is valid for any place and time and cherished by people. `People could not keep themselves away from Islam for its righteousness, simplicity, credibility, and comprehensiveness. The present study aims at dealing with this issue objectively and moderately. It adopts three approaches: the first is the analytical approach through which texts are analyzed to deduce general rules on rights of non-Muslims; the second is the comparative approach through which the disagreement etiquette shows how controversial issues should be handled, the third is the critical approach through which weak and deviant opinions are refuted. The study reaches the following conclusions: Quran and Sunnah assert that it is obligatory to be kind and generous to non-Muslims in the Islamic society. It is forbidden to make their lives, money, and honor subject to danger. Being just and forgiving with non-Muslims is among inherent ethics originating from Muslims’ faith and beliefs
