|a حقيقة أن مسالة انتقال الدول النامية إلى عصر التكنولوجيا لا تتوقف على حجم التكنولوجيا المنقولة، وإنما على آليات نقلها وما تحمله من معارف فنية وخبرات ومهارات تقنية، ومن أهم هذه الآليات العقود الحديثة لنقل التكنولوجيا نركز على أبرزها، عقدي الفرانشيز (Franchise) والبوت (B.O.T)، باعتبارهما يمثلان نقلاً حقيقياً للقدرات التكنولوجية، والمقومات التي على أساسها تتمكن الدول النامية من استيعاب التكنولوجيا وتوطينها والسيطرة عليها، غير أنه نظراً لاختلاف المستوى الفني والعلمي بين الدول الصناعية الكبرى والدول النامية باتت هذه الأخيرة تواجه العديد من الصعوبات في تحقيق الأهداف التكنولوجية والتنموية المرجوة من عقدي نقل التكنولوجيا (الفرانشيز – البوت)، بسبب عدم أهلية الدول النامية لاستيعاب التكنولوجيا المنقولة وتطويعها، والتي تتوقف على عدم وجود تهيئة محلية موائمة بالإضافة إلى عدم توفر بيئة قانونية معقولة.

Despite the fact of the deference between the industrial countries and developing ones, This last becomes face a lot of obstacles to overcome and achieve their goals by these contracts (franchise and BOT), because the inability of these countries to handling and controlling the transferred technology in addition to that it depends on the lack of suitable local organization and reasonable law and legal environment localization.
