المستخلص: The Sport Salam: It is contract of forward sale of welldefined commodity to be delivered on the sport against sport counter value. The majority Shariah scholars among the Companions, their followers and Shariah Scholars of Hanefites Malikites, Hanbalites and Al-Dhawahireete, opined of the impermissibility of the Al-Salam Al-Hal the Spot Salam. However, the Shafites, Abu Thawr, Ibn Al-Mundhir, Al-Lakhami from the Malikites scholars had permitted it besides some Malikites scholars. Imam Ibn Tiamiya and Ibn Qayyim had the moderate opinion that the Spot Salam is permissible in case the well-defined Salam commodity it available with the seller at the time agreement. The paper concluded that the Spot Salam is impermissible; because it is prohibited to sell what one doesn’t possess, and involvement of the risk factors in delivery and the price-fluctuation as well. The study also preferred the opinion of Malikites and Hanbalites in estimating the required period with regards to the period that would effect on the price fluctuation.
