المستخلص: يتناول هذا البحث لائحة الذوق العام في ضوء نظام الذوق العام في المملكة العربية السعودية والفقه الإسلامي، وقد جاء في مقدمة، وتمهيد، ومبحثين، وخاتمة، أما المقدمة: فقد اشتملت على أهمية الموضوع وأسباب اختياره، وأهدافه، والدراسات السابقة، ومنهج البحث، وخطته، وجاء التمهيد في التعريف بالذوق العام وأهميته، وأثره على الفرد والمجتمع، والمبحث الأول في آداب الذوق العام في النظام في المملكة العربية السعودية والفقه الإسلامي، وفيه مطلبان: المطلب الأول: آداب الذوق العام في النظام السعودي الوارد في اللائحة، والمطلب الثاني: التأصيل الفقهي لما ورد في اللائحة من آداب الذوق العام، وأما المبحث الثاني: فقد تناولت العقوبات الصادرة ضد مخالفي اللائحة، وموقف الفقه الإسلامي منها، وفيه مطلبان: المطلب الأول: العقوبات الصادرة ضد مخالفي الذوق العام، والمطلب الثاني: موقف الفقه الإسلامي من هذه العقوبات. وأما الخاتمة: فقد تناولت أهم النتائج التي توصل إليها البحث، وكان من أهمها: أن الذوق العام هو: مجموعة القواعد المتعلقة بصون القيم الأخلاقية السليمة التي تؤثر في بناء المجتمع وسلامته، وهي جميع المحامد والمحاسن والأخلاق والعادات، والآداب التي تحكم السلوك، والذوق وضع الأشياء في موضعها، وهو كل ما يستحب من المعاني والأفعال، وأن المواد الواردة في لائحة النظام السعودي عن آداب الذوق العام من المقاصد التحسينية التي جاءت الشريعة الإسلامية بها وأمرت بالمحافظة عليها، وأن العقوبات في الشريعة الإسلامية جزاء وضعه الله للردع عن ارتكاب ما حظر وترك ما أمر وشرعها لعباده لحفظ مصالحهم وإقامة العدل بينهم وإرشادهم إلى الطاعة ومنعهم عن المعاصي، وهي عقوبة مخالفة آداب الذوق العام عقوبة تعزيزية، وهي مفوضة إلى رأي القاضي، يختار نوع العقوبة ومقدارها، التي يرى مناسبتها لزجر الجاني، مراعيا في ذلك ظروف الجاني والجريمة والمجني عليه والزمان والمكان، وأن التعزيز بأخذ المال مناطاً بالحاكم، فمتى ما رآه عمل به، ومتى ما رأى تركه تركه. فهناك من يناسبه السجن، وهناك من يردعه الأخذ من ماله.

this research deals with the list of general taste in the light of the system of general taste in the Kingdom of Saudi Arabia and Islamic jurisprudence, and it came in the introduction, introduction, two studies, and a conclusion, while the introduction: it included the importance of the topic and the reasons for its selection, goals, previous studies, research method, and its plan, The introduction came in defining general taste and its importance, its impact on the individual and society, and the first topic in the etiquette of public taste in the system in the Kingdom of Saudi Arabia and Islamic jurisprudence, and it has two requirements: the first demand: etiquette of public taste in the Saudi system contained in the list, and the second requirement: jurisprudential rooting When it was mentioned in the regulations It is one of the etiquette of public taste. As for the second topic, it deals with the penalties issued against those who violate the regulations, and the position of Islamic jurisprudence thereof, and it has two requirements: The first demand: sanctionslssued against violators of public taste, and the second requirement: the position of Islamic jurisprudence of these sanctions. As for the conclusion: it addressed the most important findings of the research, and the most important of them were: that general taste is: the set of rules related to preserving sound moral values that affect the building and safety of society, which are all praises, merits, ethics and customs, the ethics that govern behavior, taste and the status of things In its place, which is all that is desirable from the meanings and actions, and that the articles contained in the regulations of the Saudi regime on the etiquette of public taste are among the improvement purposes that Islamic law came in and ordered to preserve them, and that the penalties in Islamic law are a penalty that God has set as a deterrent from committing what was prohibited and left what He ordered u He sponsored it in his slaves to preserve their interests, establish justice between them, guide them to obedience and prevent them from sins, which is a punishment that violates etiquette of public taste, a discretionary punishment, which is delegated to the opinion of the judge, chooses the type and amount of punishment, which he sees as appropriate for the offender’s offense, taking into account the circumstances of the offender, the crime, the victim, time and place And that the condolence is to take the money entrusted to the ruler, when he saw what he did, and when he saw that he left it. There are those who are suitable for imprisonment, and there are those who deter him from taking his money.
