المستخلص: As it is known, the texts of the Holy Qura’an and the Sunnah are the first references for fatwa, so if the text is conclusive and significant, it is not permitted to violate it, and if there was suspicion in the evidence or its significance, it becomes the subject of the diligence of the diligent and there is no denying between them. As Muslims, we should take advantage of the knowledge of the previous jurisprudence scholars of the nation and build upon it, and we are obligated to adhere to the criteria considered by scholars in reasoning. In addition, it is important to benefit of those with expertise in the different areas of life in the process of making a fatwa, within the limits of their specialties. The legal ruling is fixed when the image of the matter and the reason for the ruling are united, and the changing in the fatwa here, it is nothing but a change in the rationale for ruling, not a change in Sharia. The future that informs the infallible has been known through revelation, because this future can only be tolerated as the truth. Also, the rulings of the nowadays time have a special reality in them that does not come down to a ruling on them without observing these regulations first. Thus, opening the door to ijtihad is considered one of the benefits of Islamic law, which makes it applicable in every time and place. Furthermore, the call to close the door to ijtihad in the Sharia is a call to jurisprudence inertia, and widespread petrification. It is recommended to highlight the tolerance and comprehensiveness of Islamic Sharia, as it did not let anything related to the human being, but spoke about it. Also, I recommend not to lose sight of the jurisprudence of calamities, and the training and preparation that it imposes, because it would open our eyes to the importance of referring to the noble origins which are the Qur’an and the Sunnah. Moreover, universities and scientific centers should be concerned with preparing muftis and caring for fatwas in all disciplines, especially Islamic ones.
