المستخلص:	Longtemps contestée, la théorie de l’imprévision est devenue inévitable dans la théorie contemporaine du contrat, elle trouve son fondement dans le principe de bonne foi contractuelle, lui-même érigé en principe directeur du droit des contrats. Mais le constat est que cette théorie suscite encore à ce jour nombres d’interrogations que ce soit pour déterminer les conditions de son application, ou les modalités de mise en oeuvre de ses effets, le contraste parait plus évident en comparant l’état de la question en droit algérien et français d’où l’importance du sujet. Long disputed, the theory of frustration has become inevitable in the contemporary theory of contract, it finds its foundation in the principle of contractual good faith, which has become one of the guiding principles in contract law theory. But the observation is that this theory still raises many questions to date whether it is to determine her conditions of application or the methods of, implementation of its effects, the contrast seems more obvious between the Algerian and French legislators hence the importance of this article.
