المستخلص: We examined in this study to which extent the decentralised system is capable to protect the environment and its sustainability, this through the administrative tasks of the local administration assigned by the decentralised authority represented by the ministry of the environment. Whereas we focused on administrative procedures and control given by the local administration basing on providing licenses and declarations until their withdraw. As the right of the local administration to reporting and controlling the temporary and final shutoff of the enterprises that do not respect the provisions of classified companies work. The local administration plays the role of protecting and appreciating the coast, and protecting as well the farmlands, water surfaces and forests. and studying briefly projects “under construction” influence on the environment, And imposing environmental taxes on individuals and institutions in violation of environmental law.

قمنا من خلال هذه الدراسة بالتعرف على مدى قدرة الجهاز اللامركزي في حماية البيئة واستدامتها، وهذا بالتطرق إلى المهام الإدارية المخولة للإدارة المحلية من قبل السلطة المركزية المتمثلة في وزارة البيئة، بحيث تم الوقوف على الإجراءات الإدارية الضبطية الممنوحة للإدارة المحلية انطلاقا من منح التراخيص والتصاريح إلى سحبها؛ كما للإدارة المحلية الحق في الإبلاغ والمراقبة والوقف النهائي والمؤقت للمؤسسات التي تخالف أحكام سير المنشآت المصنفة، وتقوم الإدارة المحلية بدور حماية الساحل وتثمينه وحماية الأراضي الزراعية والمسطحات المائية والغابات؛ ودراسة موجزة لتأثير المشاريع قيد الإنجاز على البيئة؛ وفرض ضرائب بيئية على الأفراد والمؤسسات المخالفة للقانونية البيئية.
