المستخلص: La question de la relation entre environnement et politique urbaine, par rapport aux évolutions engendrées par le développement urbain soutenable, semble être une très bonne entrée pour comprendre et analyser les réalités du quotidien Algérien. Les exigences de la dimension environnementale semblent en effet poser un réel défi au droit de l’urbanisme. Dans ce sens des questionnements pertinents auxquels le droit de l’urbanisme par le biais de ces outils, doit agir et réagir deviennent de plus en plus persistants. Comment la politique urbaine pourrait-elle intégrer de manière efficace les préoccupations environnementales ? Et les instruments de la planification urbaine, conçus avant l’émergence du développement soutenable sur la scène publique Algérienne, ont-ils été adaptés et capables d'intégrer les principales questions environnementales dans un contexte de Boom en matière de projets? La question principale de cet article est d’évaluer la pertinence des actuelles et des nouvelles dispositions juridiques d’ordre urbain en ce qui concerne la prise en compte de la dimension environnementale et d’examiner leur mise en oeuvre effective, dans un projet de régénération urbaine d’un quartier central à Constantine. Transformé en une énorme friche urbaine après son éradication, ce quartier attend une intervention publique significative.

The question of the relationship between environment and urban policy in relation to evolutions brought by sustainable urban development seems to be a very good entry to understand and analyze the different day-to-day realities. The persistence and recurrence of the environmental dimension seems indeed to pose a challenge to urban law. Questions such as how planning-law should act and react become increasingly persistent. How urban policy can take into account environmental concerns effectively? In addition, what about the planning instruments, designed before the emergence of sustainable development on the Algerian public arena, have they been adapted? Are they able to integrate environmental key issues? The main issue of this article is to evaluate the relevance of current and new urban provisions regarding the inclusion of the environmental dimension and to examine their effective implementation, in an urban regeneration project situated in a central area in Constantine. This project turned into a huge urban brownfield, expecting a significant public intervention. This latter seems however, quite hard to materialize and starts very slowly.
