|a يمثل الطفل عمق البنية الأساسية للمجتمع، وعلى هذا الأساس توالت الدول العربية على إصدار قوانين خاصة بالطفل، منها قانون حقوق الطفل الكويتي رقم 21/ 2015، والذي تضمن مجموعة من الحقوق الخاصة بالطفل. وتتلخص هذه الدراسة في تقسيمها إلى مبحثين: نتناول في الأول دراسة حقوق الطفل وفقا لقانون الطفل، حيث كفل قانون الطفل الكويتي مجموعة من الحقوق والحريات العامة للطفل بالمادة الثالثة، ونص على أربعة منها تحديدا. الأول: مبدأ أولوية مصالح الطفل، والثاني: حق الطفل في أسرة متماسكة، والثالث: حق الطفل في المساواة، والرابع: حق الطفل في حرية التعبير والحصول على المعلومات. وأضفنا إليها بعض الحقوق والحريات العامة للطفل الواردة في اتفاقية حقوق الطفل، وهي أربعة، الأول: حرية الطفل في الاعتقاد، والثاني: حق الطفل في السمعة والشرف، والثالث: حق الطفل في الخصوصية، والرابع: حق الطفل في الترفيه. وخصصنا المبحث الثاني، لدراسة حقوق الطفل في بعض القوانين الأخرى، من حيث بداية تمتع الطفل بالشخصية القانونية وكيفية إثباتها، كما تناولنا حق الطفل في اسم لائق يميزه عن غيره وكيفية تغيير هذا الاسم، وبينا أهمية موطن الطفل القانوني، وحقه في الجنسية، ومشكلة انعدام الجنسية في الكويت، كما بينا أهمية تحديد جنس الطفل، نظرا لما قد يتعرض له بعض الأطفال أثناء فترة البلوغ إلى مشاكل اضطراب الهوية الجنسية، كما بينا أهمية الأحكام التي تطبق على الطفل تبعا لديانته، وتناولنا الذمة المالية للطفل، وحق الطفل في الحياة وسلامة جسده، وختمنا البحث بأهم النتائج والتوصيات.

|b The child represents the infrastructure of community, so that the whole Arabian countries had issued special laws for the child. One of these laws is the Kuwaiti law of child’s rights number 21/2015 which involves some of rights of child. This study is summarized in two chapters. The first chapter discusses the rights of child under the umbrella of child’s law. The Kuwaiti law of child’s rights guaranteed group of rights and public freedom for child in the third article. Meanwhile, the third article discussed the child’s right to equality and the fourth article discussed the child’s right of expression and getting knowledge. We had added some public rights and freedoms from the convention on the rights of the child such as: child’s freedom of belief, child’s right of reputation and honor, child’s right to privacy and the child’s right to entertainment. The second chapter discussed some other laws such as having the legal personality for the child and the way of proving it. We discussed also the right of child to have a proper name to distinguish him and having the right to change it. We had discussed the importance of having legal citizenship and nationality. We focused on the problem of statelessness in Kuwait. We discussed also the importance of determining the gender of the child, because there are some children “at the time of puberty” suffer from gender identity disorder. We illustrated also the importance of applying the rules according to religion, the child’s financial liability and the child’s right to live in peace and saving his body. We concluded this study by providing some results and recommendations.
