المستخلص: من المؤكد أن ظواهر التلوث البحري والخصائص الطبيعية للبيئة البحرية تتجاهل الحدود المرسومة، وهو ما يجعل المشاكل التي تطرأ داخل المياه الخاضعة لسيادة الدولة أو ما وراءها يتطلب حلولا موحدة؛ عن طريق التداخل المتبادل بين القانون الدولي العام والقانون الخاص. وانطلاقا من ذلك فإن دراسة موضوع حماية البيئة البحرية من التلوث الصادر عن السفن، يقتضي الإحاطة بمختلف القواعد والآليات القانونية للتصدي لأخطار هذا النوع من التلوث؛ لأن عبارة "الحماية القانونية" تحيل إلى فكرة الوسائل والأهداف المتبعة، وبالتالي نكون أمان قاعدة جوهرية فحواها أن القانون الدولي ينصب على التلوث كظاهرة، وليس على النطاق الجغرافي الذي يحدث فيه. الشيء الذي يفرض التزاما دوليا يشمل حماية البيئة البحرية للمناطق الغير خاضعة للاختصاص الوطني.

Certainly, the phenomena of marine pollution and the natural characteristics of the marine environment ignore the demarcated boundaries, which makes the problems that occur within or beyond the waters under state jurisdiction require uniform solutions; through mutual overlap between public international law and private law. Accordingly, the study of the protection of the marine environment from pollution from ships requires taking note of the legal rules and mechanisms to deal with the dangers of this type of pollution. International focuses on pollution as a phenomenon, not on the geographical scale in which it imposes an international obligation that includes the protection of the marine environment of areas not subject to national jurisdiction

Certes, les phénomènes de pollution marine et les caractéristiques naturelles du milieu marin ne tiennent pas compte des frontières délimitées, de sorte que les problèmes rencontrés dans les eaux relevant de la juridiction des États ou au-delà exigent des solutions uniformes, grâce au chevauchement entre droit international public et droit privé. Par conséquent, l’étude de la protection du milieu marin contre la pollution par les navires nécessite de prendre connaissance des règles et mécanismes juridiques permettant de faire face aux dangers de ce type de pollution, car le terme "protection juridique" renvoie à l’idée des moyens et des objectifs suivis, et constitue donc une règle de sécurité. International se concentre sur la pollution en tant que phénomène et non sur l’échelle géographique dans laquelle elle impose une obligation internationale qui inclut la protection de l’environnement marin de zones non soumises à la juridiction
