المستخلص: يؤكد الكثير من المختصين في مجال الطب النفسي والشرعي أن التحرشات الجنسية من أكثر الجرائم السرية المسكوت عنها في الجزائر، والتي يذهب ضحيتها يوميا النساء العاملات؛ الذين يجدون أنفسهم عاجزين عن إثبات ما تعرضوا له من تحرشات عادة ما تخلف آثارا نفسية مدمرة يعجز الطبيب الشرعي عن إثباتها، مما يساهم في انتشار هذا النوع من الجرائم التي هي بحاجة إلى آليات طبية وقانونية جديدة لإثباتها. هذا ما دفع المشرع الجزائري إلى تكريس حماية جزائية للمرأة من التحرش الجنسي في تعديله لقانون العقوبات بموجب المادة 341 مكرر من القانون 04/15 المتضمن قانون العقوبات. وبذلك يكون المشرع قد أخرج هذه الجريمة من دائرة المسكوت عنها سياسيا واجتماعيا وقانونيا إلى دائرة الحظر والمنع القانوني المقترن بالجزاء.

This prompted the Algerian legislature to devote penal protection to women from sexual harassment in its amendment to the Penal Code under article 341 bis of Law 04/15, which includes the Penal Code. De nombreux spécialistes dans le domaine de la psychiatrie et de la charia confirment que le harcèlement sexuel est l’un des crimes les plus secrets d’Algérie, qui tue des travailleuses quotidiennes qui se retrouvent dans l’impossibilité de prouver que le harcèlement dont elles sont victimes finissent souvent par avoir des effets psychologiques dévastateurs que le médecin légiste ne peut prouver. Ce qui contribue à la propagation de ce type de crimes pour lesquels il est nécessaire de disposer de nouveaux mécanismes médicaux et juridiques. Cela a poussé le législateur algérien à consacrer une protection pénale aux femmes contre le harcèlement sexuel dans son amendement au Code pénal en vertu de l'article 341 bis de la loi 04/15, qui inclut le Code pénal. Le législateur a ainsi retiré ce crime du cercle politique, social et juridique à l'interdiction formelle et à l'interdiction légales. La peine.
