|a تعد أزمة تغير المناخ من القضايا الأساسية التي تتصدر المشهد العالمي في عصرنا هذا، فظاهرة الاحتباس الحراري وتأثيراتها الخطيرة على كوكب الأرض أصبحت تشكل تهديدا مستمرا ومتناميا لشعوب العالم أجمع، فرادى وجماعات، شعوبا متطورة أو سائرة في طريق النمو، الشعوب الحاضرة أو المستقبلية، وإن كانت هناك فئات ومناطق أكتر تضرر من البقية. في العقود الأخيرة أخذت هذه الجائحة الإنسانية-الطبيعية بعدا إقليميا ودوليا، وأمام الوضع الكارثي الذي ألم بمناخ الأرض تعالت الصيحات والنداءات بوجوب تدخل عاجل لهيئات ومؤسسات المجتمع الدولي من أجل صياغة ووضع قواعد وآليات قانونية ملزمة للدول -وخصوصها الصناعية منها-، تمهيدا لاعتماد نظام متعدد الجوانب قائم على قواعد قانونية ملزمة بشأن تغير المناخ يطبق على العالم بأسره، نظام يسمح بمراقبة دورية ومستمرة لمساهمات الدول في انبعاثات الغازات الدفيئة ويقيم اعتبارا للتفاوت الاقتصادي والمالي بين الدول الصناعية والدول النامية، نظام يمكننا من تخفيف آثار تغير المناخ والتكيف معها.
