المستخلص: تعد أرض ما محتلة عندما تكون تحت السيطرة والإدارة الفعلية للمحتل، وتنص المادة 42 من لائحة لاهاي على التعريف التالي: "تعتبر أرض الدولة محتلة حين تكون تحت السلطة الفعلية لجيش العدو ولا يشمل الاحتلال سوى الأراضي التي يمكن أن تمارس فيها هذه السلطة بعد قيامها". يختلف الاحتلال تمام لاختلاف عن الغزو: وهو دخول القوات المحاربة في إقليم العدو، وهي من العمليات الحربية وقد تمتد إلى أن يتم أحكام السيطرة على الإقليم. الفتح: وهو نقل السيادة تماما من إقليم تابع لدولة إلى سيادة دولة أخرى.

Une terre est considérée occupée quand cette dernière est sous la prédominance et la gérance effectives de l’occupant, l’article 42 de la résolution de Lahaye contient la définition suivante « une terre d’un état est considérée occupée quand cette dernière est sous le pouvoir effectif de l’armé de l’ennemi, l’occupation ne concerne que les terres sur lesquelles le pouvoir est exercé après son établissement.
L’occupation se diffère complètement de : L’invasion : la pénétration des forces de combat sur le territoire de l’ennemi et des opérations militaires s’étendent jusqu'à la prédominance du territoire. CONQUETE : le transfert complet de la souveraineté du territoire d’un état à un autre.


A territory is occupied when it is under the effective control and management of the occupier. Article 42 of Hague Regulations provides the following definition: Territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation applies only to the territory where such authority is established and in a position to assert itself”. The occupation is completely different from the invasion: it is the entry of the warring forces into the enemy territory, which is a military operation and may extend until the provisions of control over the territory are taken. Conquest means the transfer of sovereignty entirely from the territory of one State to the sovereignty of another State.
