المستخلص: فقد اخترت الكتابة في موضوع بعنوان: المقاصد الشرعية في عوارض الأهلية، وأهدف من ذلك إلى بيان أن هذا الدين قائم على مراعاة المصالح في جميع تشريعاته، وأن المقاصد الشرعية لها جانبها التأصيلي الذي عني به الأصوليون، ولها جوانبها التطبيقية المتعددة، والتي اخترت منها عوارض الأهلية عند الأصوليين؛ لوضوح المقاصد الشرعية في موضوعاتها ومباحثها المتعددة بصورة أكثر تطبيقا وفهما من غيرها من أبواب الأصول، وحيث لم يسبق الكتابة في هذا الموضوع اتبعت فيه المنهج الوصفي والاستنباطي مع التحليلي والتطبيقي. وقد كان من أهم نتائج البحث التأكيد على أن هذه الشريعة ما أنزلت إلا لمصالح العبـاد في العاجل والآجل، وأن المصالح الشرعية أصل أصيل من أصول ملتنا، وأن صحة الفتيا لا تكون إلا بفهمها وإدراكها، وأن عوارض الأهلية كانت الأنموذج الأوضح، والتطبيق الأمثل لقواعد المقاصد ومراعاتها في التشريع تأصيلا وتطبيقا، وكان مقصد الضرورة ومقصد الحاجة سائدين في اشتراط الأهلة للمكلف وما يطرأ عليها من عوارض سماوية أو مكتسبة، ولمسنا من كل ذلك عناية الشارع بربط تكليفاته بوجود أهلية في المكلف توجب له وعليه الحقوق تجاه خالقه والمخلوقين، وتحدد كيفية الأداء وزمنه، وما يعرض عليه من عوارض تمنعه أو تنقصه. وإن من أهم ما أوصي به: السير عل المنوال نفسه في أبواب الأصول والفروع؛ نظرا لحاجة الناس إلى معرفة ما أراده الله من تشريعاته؛ حتى تقبل نفوسهم على الامتثال بصورة أكمل، ويزدادوا إيمانا على إيمانها.

I have selected the topic titled "Legislative (Sharia) Purposes in Eligibility Symptoms". The aim of this study is to indicate that this religion relies on considering the interests of people in all its legislations. The legislation purposes have its inherent side, which fundamentalists concerned. Moreover, legislative Purposes have its multiple application aspects, from which I have exclusively selected "Eligibility Symptoms of Fundamentalists"; given the clarity of its legislative purposes in its subjects and varied research aspects in away more applicable and understandable than the other fundamentals chapters. No one wrote about this topic before. In this study, I used the descriptive and inductive approach as well as the analytic and applied one. The most prominent results of this research is to confirm and enhance that this Sharia was revealed only for the worshippers' interests sooner or later, and the legitimate interests are an authentic origin of our religion fundamentals. The credibility and correctness of Fatwa (giving the legitimate rule) will not be true and perfect without its understanding and realizing. The eligibility symptoms were the clearest model and the perfect application to the purposes rules that can be taken into consideration in the legislation inherently and applicably. The purposes of necessity and need were prevailing in eligibility terms for the legitimate competent (to perform the religious duties in Islam) with the heavenly and acquired symptoms that can be occurred. We found from all these things; the legislator’s concern of correlating his tasks and responsibilities with the existence of eligibility in the competent that make him holds the responsibility before his Creator and the creatures. In addition, it determines the manner and time of performance and the obstacles that can prevent or diminish it. The most important recommendations were to continue on the same line regarding the chapters of fundamentals and sub-fundamentals; due to the people’s need to recognize what Allah (SWT) wants in his legislations, in order to motivate them to comply by these legislations perfectly and to add faith unto their faith.
