المستخلص: En vertu de la loi 07/02 le législateur algérien adopte un nouveau mécanisme pour régir la propriété foncière. Ce dernier peut se définir comme une procédure d’enquête foncière et se distingue des mécanismes antérieurs. Il se fait à la demande d'une personne physique ou morale. L’importance et la spécificité de ce mécanisme exigent le respect d’un ensemble de conditions, sous le contrôle du conservateur foncier de la wilaya, en coordination avec l'enquêteur foncier. Si aucune objection n’a été établie, ou si une objection a été résolue aux niveaux administratif et judiciaire, ou, en général si les résultats de l’enquête se sont avérés positifs, le titre de propriété sera enfin délivré à la partie concernée.

استحدث المشرع الجزائري بموجب القانون 07/02 المتضمن إجراء لمعاينة حق الملكية العقارية وتسليم سندات الملكية عن طريق تحقيق عقاري، آلية جديدة لضبط وتطهير الأملاك العقارية تختلف عن الآليات السابقة، تتمثل في إجراء التحقيق العقاري الذي يتم بناء على طلب شخص طبيعي أو معنوي بشرط توافر جملة من الشروط، ونظرا لأهمية هذا الإجراء وخصوصيته فإنه يتطلب توفير مجموعة من الشروط، يكون بإشراف المدير الولائي للحفظ العقاري وبالتنسيق مع المحقق العقاري والمحافظ العقاري، وإذا لم تسجل اعتراضات أو تم الفصل فيها إداريا أو قضائيا وبصفة عامة إذا كانت نتائج التحقيق إيجابية يسلم سند الملكية للطرف المعني.

Algerian legislator under the law 07/02 has introduced a new mechanism to control the property that differs from previous mechanisms. This mecanism is defined as a real investigation process. It is made at the request of the natural or moral persons and requires the availability of a number of conditions under the supervision of the director of property registry of the department, in coordination with the Investigator and the Commissioner of Lands. If no objection may be made, been adjudicated on administrative or judicial levels, or, in general, if the investigation results were demonstrably positive, the title deed will be finally issued for the Party concerned.
