المستخلص: تمثل فكرة التضامن الاجتماعي المبنية على خلق التبرع، أساس عمليات نقل وزرع الأعضاء البشرية، أين نجد المشرع قد أباح بموجبها المساس بالتكامل الجسدي للمانح، والذي يكون برضاه، في سبيل إعادة النشاط للوظائف الحيوية للمستقبل، وتخليصه من آلامه ضمن القيم الإنسانية العليا، بعيدا عن الاتجار بالأعضاء البشرية، الأمر الذي لا يمنع من مكافأة المانح عن سلوكه الرفيع اتجاه المستقبل.

The idea of built-up social solidarity to create a donation represents the basis of transplantation of human organs, for which the legislator has permitted compromising the physical integration of the donor which is with his consent, in order to restore the activity of the vital functions for the receiver, and to free him from his suffering in the framework of the upper human values, away from trafficking of human organs, which does not prevent from paying the donor of his rigorous behavior towards the receiver.

L'idée de solidarité sociale intégrée pour créer une base de dons d’organes représente la base des opérations de transfert et de transplantation des organes humains. Pour le législateur, la transplantation, a permis de toucher à l'intégration physique du donneur, qui sera avec ou sans son consentement, afin de rétablir l'activité des fonctions vitales pour le récepteur, et d’alléger ses souffrances dans le cadre des valeurs humaines, loin du trafic d'organes humains. Ce qui n’empêche pas de récompenser le donateur pour son comportement exemplaire.
