La question des droits de l’homme est devenue le centre d’intérêt de la société internationale, notamment en ce qui concerne la protection des civils de la répression dont ils peuvent être victimes, par suite de leur volonté d’exprimer leurs opinions et de proclamer certains droits sociaux, politiques et culturels. Obligeant ainsi, la société internationale d’étendre sa protection, et cela par l’application du principe de la responsabilité de protéger, ce dernier a été mis en application pour la première fois en Libye pour protéger les civils. Le Conseil de sécurité a qualifié la situation dans ce pays comme une menace pour le processus de paix et de sécurité internationales. C’est pourquoi, il a rendu la première résolution numéro 1970 du 26 février 2011, par suite de son inexécution, une deuxième résolution a été rendue sous le numéro 1973 du 17 mars 2011 en recourant à l’intervention militaire de l’O.T.A.N pour l’exécution de cette dernière. أصبحت مسألة حقوق الإنسان محل اهتمام المجتمع الدولي ولا سيما حماية المدنيين من القمع الذي يتعرضون له من حكوماتهم جراء المطالبة ببعض الحقوق الاجتماعية والسياسية والثقافية، مما أدى بالمجتمع الدولي للتدخل لحمايتهم تجسيدا لمبدأ مسؤولية الحماية، طبق هذا المبدأ لأول مرة في ليبيا، حيث كيف مجلس الأمن الوضع في ليبيا بأنه تهديد للأمن والسلم الدوليين، وأصدر القرار الأول رقم 1970 بتاريخ 26 فيفري 2011، نتيجة لعدم التزام ليبيا بما تضمنه القرار السالف الذكر، وتم استصدار قرار ثان تحت رقم 1973 بتاريخ 17 مارس 2011، حيث فوض من خلاله حلف شمال الأطلسي للتدخل لتنفيذ القرار باستخدام القوة يتناول هذا المقال مسؤولية الحماية الذي حل محل التدخل الإنساني، وممارسة مجلس الأمن لمسؤولية الحماية في ليبيا. The issue of human rights has become the focus of attention of the international community in particular as regards protecting civilians who are exposed to repression from their government for claiming some of their social, political and educational rights which obliged the international community to interfere and protect them, by applying the principle of the responsibility to protecting. This principle was used for the first time in Libya, according to the terms of how the security council explained the situation in Libya as a threat to the international peace and security It therefore issued the first decision N° 1970 on the February 26th, 2001, as a result to the non-compliance of Libya with the decision that has been mentioned before. Because of this, a second decision has been issued under the N° 1973 on the 17th of march 2011, where he authorised throuth the NATO to intervene and execute the decision using force, this article refers to the responsibility of protecting that replaced human interference, and the practice of security council the responsibility of protecting in Libya. |
