لقد تعرضت لدراسة عقد الفرنشايز وذلك بتناول جوانبه من الناحية القانونية وذلك من خلال مبحثين أساسيين. تعرضت في المبحث الأول لتعريف عقد الفرنشايز وتوصلت إلى أن جميع الآراء الفقهية قد ركزت على العلاقة التعاقدية بين طرفي عقد الفرنشايز مع التأكيد على أن الالتزامات المترتبة كأثار للعقد تقع على عاتق عاقديه. وبشأن الطبيعة القانونية لعقد الفرنشايز وفى ضوء الاختلافات الجمه حول طبيعة هذا العقد فقد انتهيت إلى أن عقد الفرنشايز من العقود الرضائية حيث ينعقد العقد بمجرد رضاء الطرفين. وفى المبحث الثاني تعرضت بالدراسة للألتزامات التي يرتبها عقد الفرنشايز واتضح من خلال هذه الدراسة إن مصدر هذه الالتزامات سواء التزامات المانح أو الممنوح له تتمثل في عقد الفرنشايز.
I have been studying the Franchise contract by addressing its aspects legally, through two basic topics. In the first part of the definition of the Franchise contract and found that all the doctrinal views have focused on the contractual relationship between the parties to the Franchise contract with the emphasis that the obligations arising as the effects of the contract falls on the shoulders of his peers. As to the legal nature of the Franchise contract and in the light of the total differences on the nature of this contract, I have concluded that the Franchise contract is a consensual contract where the contract is held as soon as the parties are satisfied. In the second topic, the study of the obligations of the Franchise contract was examined. It became apparent through this study that the source of these obligations, whether the grantor's obligations or the grantee's, is the Franchise contract.
