هذا البحث بعنوان: "القواعد والضوابط الفقهية عند الإمام البهوتي في العبادات دراسة نظرية تطبيقية من خلال كتاب الروض المربع: ويُعد هذا البحث رسالة علمية مقدمة لنيل درجة الماجستير في الفقه وأصوله، تُعنى باستخراج القواعد والضوابط الفقهية التي أوردها الإمام البهوتي في العبادات من كتاب الروض المربع، مع شرحها وبيان معناها وأدلتها، وذكر أهم فروعها. وتم من خلالها جمع شتات القواعد والضوابط الفقهية المتناثرة في كتاب الروض، وربط الجانب النظري في القواعد والضوابط الفقهية بالجوانب التطبيقية، والمساهمة قدر الإمكان في إثراء المكتبة الحنبلية بالقواعد والضوابط الفقهية. وقد قسمت الرسالة إلى فصلين يسبقهما تمهيد ومقدمة، وتتلوهما خاتمة. وقد تناول التمهيد التعريف بالإمام البهوتي رحمه لله وكتابه، وبعلم القواعد والضوابط الفقهية. وتناول الفصل الأول القواعد الفقهية العامة في العبادات في الروض المربع، وهي: قواعد النيات، وقواعد اليقين والشك، وقواعد التيسير، وقواعد العرف والعادة، وقواعد المصالح، وقواعد التابع، وقواعد متفرقة. وأما الفصل الثاني فتناول الضوابط الفقهية الخاصة ببات من أبواب العبادات في الروض المربع، وهي: ضوابط كتاب الطهارة، وضوابط كتاب الصلاة، وضوابط كتاب الجنائز، وضوابط كتاب الزكاة، وضوابط كتاب الصوم، وضوابط كتاب المناسك، وضوابط كتاب الجهاد. وخلصت الرسالة إلى عدة نتائج، من أهمها: أهمية علم القواعد والضوابط الفقهية في جمع شتات المسائل والفروع الفقهية، مما يسهل دراستها والنظر فيها. عظم شأن كتاب الروض المربع للإمام البهوتي رحمه الله، فعلى الرغم من صغر حجمه إلا أنه حوى كثيرا من المسائل والتفريعات، والأدلة والتعليلات والتي جاءت في كثير من المواضع كقواعد وضوابط فقهية. امتازت القواعد والضوابط الفقهية عند الإمام البهوتي رحمه الله بأصالتها، ووضوح ألفاظها، وإيجاز عبارتها. ظهر من خلال البحث اهتمام الحنابلة عامة، والإمام البهوتي رحمه الله خاصة بعلم القواعد والضوابط الفقهية، وقد دل على ذلك كثرة القواعد والضوابط الفقهية الموجودة في ثنايا كتبهم ومدوناتهم الفقهية. وتضمنت أبرز التوصيات: الاهتمام بكتب الإمام البهوتي رحمه الله فهي مليئة بالقواعد والضوابط الفقهية، التي تحتاج إلى إبراز ودراسة. الاهتمام بدراسة القواعد الفقهية عند الحنابلة، بعيدا عن الخلافات الفقهية؛ لتوليد فكر تقعيدي حنبلي، يستفيد منه طالب العلم عند البحث في القواعد الفقهية.
The research entitled "Jurisprudential Rules and Conditions on Ibadat for Imam AlBahuti: An Applied Theoretical Study from Al Rawd Al Muraba' Book" is a scientific thesis submitted for obtaining the Master Degree in Jurisprudence. The research aims to present the jurisprudential rules and conditions on Ibadat as described by Imam AlBahuti in his book "Al Rawd Al Muraba'", along with their definitions, evidence, and most important principles. The thesis collected the different jurisprudential rules and conditions in Al Rawd Al Muraba' and linked the theoretical side of them with the practical side. The thesis'saim is to enrich the Hanbalilibrary with those jurisprudential rules and conditions as much as possible. The thesis is divided into a background, introduction, two chapter, and conclusion. The background talked about Imam AlBahuti, may Allah have mercy on him, his book, and the jurisprudential rules and conditions. The first chapter presented the general jurisprudential rules on Ibadat which are, as quoted from Al Rawd Al Muraba': rules of intentions, rules of certainty and suspicion, rules of facilitation, rules of custom and tradition, rules of interests, rules of subordinate, and miscellaneous rules. The second chapter discussed the jurisprudential rules regarding on chapter of Ibadat in Al Rawd Al Muraba': rules of the Book of Purity, Book of Prayer, Book of Funerals, Bookof Zakat, Book of Fasting, Book of Rites, and Book of Jihad. The study concludes with many findings mainly: The importance of the jurisprudential rules and conditions in gathering different jurisprudential matters so as to facilitate their studying and understanding. The book of Rawdh Al Murabbi of Imam AlBahuti has great importance despite its small size as it contains many jurisprudential matters, evidence, and explanations in the form of jurisprudential rules and conditions which are characterized by authenticity, clarity and conciseness. The research reflects the interest of Hanbali scholars, in general, and Imam AlBahuti, in particular, of the jurisprudential rules and conditions as evidenced by many rules and conditions in their jurisprudential book and blogs. The most prominent recommendations are as follows: the books of Imam AlBahuti should be given top priority for their abundance of the jurisprudential rules and conditions that need to be studied. The Hanbali jurisprudential rules should be studied away from any jurisprudential differences to create a Hanbali conventional thinking to benefit the student in researching the jurisprudential rules.
