|a إن حماية البيئة والمحافظة عليها يقتضي إيجاد نصوص قانونية كفيلة بمعالجة المشكلات والتحديات التي تواجهها، وهو ما سعت إليه دول الوطن العربي من خلال سن القوانين المتعلقة بالبيئة، إلا أن هذه الأخيرة لا تكفي وحدها لإضفاء الحماية اللازمة للبيئة وإنما يجب تفعيل دور مختلف المؤسسات والهيئات المتخصصة في مجال الشأن البيئي. فإلى أي مدى ساهمت قوانين وتشريعات دول الوطن العربي في إضفاء الحماية على البيئة وماهي أهم الإشكالات التي تواجه هذه الحماية؟ بالتطلع إلى النصوص القانونية لبعض دول الوطن العربي في مجال البيئة نخلص إلى أن هذه الدول قد سعت إلى إيجاد الأسس والقواعد الخاصة بحماية البيئة وعملت على وضع الآليات الكفيلة بالمحافظة عليها. إلا أن هذه الحماية تعترضها في كثير من الأحيان مجموعة من العراقيل والصعوبات التي تحد من تفعيل النصوص القانونية ومن اتخاذ التدابير والإجراءات الكفيلة بحماية البيئة.

|b It is necessary to protect the environment and preserve it by creating legal texts that are sufficient to the problems and challenges facing them. This is what the Arab countries have sought through the enactment of the laws related to the environment. However, the decline of the latter is not sufficient to provide the necessary protection for the environment, but rather the role of the different organizations and institutions specialized in the field of environment. To what extent did the laws and legislations of the Arab countries of the environment and what are the problems facing this protection…. We look forward to the legal texts of some Arab countries related to environment. We conclude that these countries have sought to la lay the foundations and rules for protecting the environment and have worked to develop the mechanisms to preserve them. However, the environment faces a number of obstacles and difficulties that limit the implementation of these legal texts. All measures and procedures are adequate for its protection.
