Since its unification on 22/5/1990, the Republic of Yemen has undergone many turns which have had a direct impact on the formation of the various state authorities and the methods of exercising power as a result of several political and non-political factors at local, regional and international levels. These factors have had a direct impact on the constitutional, legal and institutional construction of the new State. The research deals with all political factors affecting the constitutional rules, starting with the drafting of the constitutional text, approving it and ending with the obstacles of enforcement during this stage. Whether the problem is in the existence of the obstacles related to the lack of the constitutional text or the political practice of those who manage the power and their infraction to the constitutional determinants which created these obstacles the result is one and the same that is lack of constitutional enforcement. The research concluded with a number of suggestions to overcome the obstacles and enhance the institutional building to reach the so-called "legal state" in which power is practiced based on pre-defined tasks and competencies in the constitutional and legal rules of the state.
مرت الدولة اليمنية منذ نشأتها في 11/5/1990م بمنعطفات عديدة أثرت تأثيرا مباشرا على نشأة سلطات الدولة المختلفة وأساليب ممارسة السلطة نتيجة عدة عوامل سياسية وغير سياسية على المستوى المحلي والإقليمي والدولي. وكان لهذه العوامل أثرا مباشرا على البناء الدستوري والقانوني والمؤسسي للدولة الجديدة. يتناول البحث مجمل العوامل السياسية التي أثرت على القواعد الدستورية بدأ من صياغة النص الدستوري وإقراره وانتهاء بمعوقات تطبيق الدستور خلال هذه المرحلة، وما إذا كانت الإشكالية في وجود هذه العوائق متصلة بقصور النص الدستوري أم أن الممارسة السياسية لمن يمارس السلطة ومخالفتهم للمحددات الدستورية أثناء هذه الممارسة هي التي أوجدت هذه العوائق التي حالت دون التطبيق السليم للمنظومة الدستورية، مختتما البحث بعدد من المقترحات لأنهاء هذه المعوقات وتجاوزها وتعزيز البناء المؤسسي لنصل إلى ما يسمى بالدولة القانونية التي تمارس فيها السلطة بناء على المهام والاختصاصات المحددة سلفا في القواعد الدستورية والقانونية للدولة.
