البحث حركة فاعلة لآلة الفقه، وإعمال منتفض لقوة الاستيعاب الكامنة، وصقل ممتن لأداة التخريج والتوصيف؛ إذ تناول الاهتزاز التنظيري لفريضة الزكاة، التي تعد عنوان الطهر المجتمعي، ورمز الانتماء للجماعة المسلمة، ومعالجة أشد القضايا أثرا على الإنسان والحياة، وهي الأمراض المستعصية. انتظم البحث في ثلاثة مباحث: المبحث الأول: الأمراض المستعصية: المبحث الثاني: صرف الزكاة للمريض. المبحث الثالث: صرف الزكاة للمؤسسات المعنية بالمريض. مفهوم الأمراض المستعصية: هي أمراض تفتك بالأنفس أو الأعضاء، وتستنزف الأموال، وتبدد الإمكانات، يعسر الشفاء منها، أو يحتاج علاجها إلى أمد طويل، وإمكانات كبيرة. وحقيقة توصيف هذه الأمراض المستعصية وجود وصف من أوصاف مصارف الزكاة، فإن وجد ذلك وجدت الأحقية في مال الزكاة. فالمريض المتحقق فيه وصف من أوصاف استحقاق الزكاة، يجوز صرف الزكاة له، كما له صرفها في كل ما من شأنه حصول الاستطباب والاستشفاء، بما في ذلك المرافق ونفقاته. ويجوز استثمار بعض أموال الزكاة بما يرجع بالمصلحة للمستحقين، من ذلك بناء مؤسسات الاستطباب، وإقامة مراكز بحثية علمية تعنى بالاستطباب، تجرى فيها الدراسات والتجارب بغية الحصول على آليات الوقاية، وأسباب المعالجة الناجعة للأمراض، ومواكبة تطور المعرفة الاستطبابية، واستثمارها استثمارا يحقق قصد الزكاة، ويسد حاجة المجتمع.
The research is an effective movement of the jurisprudent instruments as well as an uplifting work of the inherited absorptive power and a tool of figuring out and description. It deals with the theoretical background of the obligatory zakat which is the head of the community purification and a symbol of belonging to the Muslim community. In addition, it deals with the most important issues affecting man and life; the chronic diseases. The research is organized into three sections: The first one: Chronic diseases. The second one: Paying zakat to the patient. The third one: Paying zakat to institutions concerned with the patient. Chronic diseases Chronic diseases end people's life, destroy organs, and expend money as well as potentials. They are either difficult to be cured or need a long time and great potentials to be treated. Zakat can also be eligibly paid to the chronic disease holder. Additionally, it is permissible to pay zakat to cases lead to recovery including hospitalization, and the patient attendant and his expenses. It is permitted to invest some money of the zakat for the benefit of the categories of people to whom zakat can be distributed. It is for the sake of building institutions of hospitalization and scientific research centers for the purpose of providing treatment and carrying out studies and experiments in order to obtain mechanisms of prevention and the causes of effective treatment of diseases as well as coping with the development of knowledge and its investment to achieve the purpose of zakat and meet the needs of society.
