المستخلص: الحمد لله رب العالمين، والصلاة والسلام على من أرسله الله هاديا إلي الطريق المستقيم وبعد: فإنه بين آونة وأخرى يثار موضوع إعادة صلاة الظهر بعد الجمعة وينقسم الناس -فضلا عن أهل العلم- بين محبذ مؤيد، وبين مانع فعلها ومتهم فاعلها بالابتداع، فرأيت لزاما على أهل العلم أن يوضحوا هذه المسألة للناس بعيد عن التحيز إلي مذهب أو رأي. ولقد تبين لي من خلال هذا البحث النقاط التالية: أ) إن فريضة الوقت يوم الجمعة هي صلاة الجمعة، فإذا أقيمت صحيحة بأن كانت واحدة فقط في البلد، فلا حاجة عندئذ لإعادة الظهر باتفاق أهل العلم، وهو المنقول –عملا- عن النبي صلي الله عليه وسلم وخلفائه الراشدين المهديين، لأنها كانت تقام جمعة واحدة في الدينة المنورة، وفي ساتر البلاد. ب) إن الخالف في إعادة الظهر بعد الجمعة سببه تعدد الجمعات في البلد الواحد، بناء على اعتبار واحدة منها صحيحة فقد عند جمهور الفقهاء إذا زادت عن قدر الحاجة. ج) إن جمهور الفقهاء يقولون بإعادة الظهر -وجوبا أو استحبابا- تبرئة للذمة عندما تتعدد الجمعة وتكون السابقة الصحيحة مجهولة. د) إن القول باعتبارها بدعة مكفرة أو تكاد تكفر بجانب الصواب، وهو بعيد عن مذاهب. أهل العلم. ه) إن الأولي لمن يعيدها أن يعيدها منفردا دفعا للفتنة والفوضى في صفوف العامة.

The question as to whether Dhuhr (Midday Prayer) should be performed subsequently to Friday Congregational Prayer is, from time to time, raised by common Muslims as well as Muslim scholars, thus resulting in two different views. While one group is in favour of performing Duhuhr prayer and considers it mandatory, a second group disapproves of such an act, looking upon it as an innovation that deviates from the Right Path. In view of this controversy . I believe that it is incumbent on scholars to address this issue objectively and in a manner that is unbiased to any doctrine school of thought. Having investigated the issue, I have arrived at the following conclusions. First, the prescribed duty enjoyed on Muslims at the time designated is Friday Congregational prayer. Once validly established by virtue of its being the only one in a given town - Friday prayer will be sufficient and. as Muslim scholars unanimously hold, there will be no need to perform Dhuhr prayer. As a matter of fact, Prophet Muhammad - peace be upon him - and the rightly-guided Caliphs are reported to have followed this approach in actual practice, for only one Friday prayer was performed in Al-Madina Al-Munawwara. Second, the controversy as to whether Dhuhr prayer should or should not be performed after Friday prayer is due to the multiplicity of Friday prayers in the same town. As it is held by the vast majority of Muslim scholars, once the Friday prayers are superfluous, only one of them is considered valid. Third, in case of a number of Friday prayers and when it is difficult to ascertain which of the preceding ones has been valid, the vast majority of Muslim jurisprudents hold that - to preclude any suspicion and to acquit one of the possibility of wrong-doing — performing Dhuhr prayer will be a mandatory or a commendable act. Fourth, the view that performing it is to be considered an act which involves disbelief (or almost leads to disbelief) is far from right, and it is not compatible with common schools of thought. Fifth, when one intends to perform it, it would be most prudent of him to do so only on an individual basis. This is to preclude any discord or within the Muslim community disrupting its unity.
