المستخلص: تعد اللامركزية الإدارية أحد صور التنظيم الإداري التي تهدف إلى حماية المصالح المحلية على مستوى الأقاليم، ولذلك لابد لهذه الوحدات المحلية من الاستقلالية لكي تتمكن من القيام بواجباتها القانونية. لذلك فتكريس اللامركزية يرتبط أساسا بمدى استقلال الجماعات المحلية في ممارسة مهامها والاختصاصات المنوطة بها، ويمكن الاستدلال على ذلك من خلال معرفة حجم تدخل السلطة اللامركزية في عمل الهيئات المحلية عن طريق ما يعرف بالوصاية الإدارية. وعلى الرغم من أن غالبية الدساتير تنص على حرية المجالس المحلية في إشباع الحاجات العامة، إلا أن الاتجاه الغالب هو منح الجهات الوصية سلطة تقديرية وواسعة لممارسة الوصاية، خاصة إذا تعلق الأمر بالمجلس المحلي ككل، وهو ما سنحاول توضيحه من خلال مقارنة مسلك المشرع الجزائري والتونسي.

Therefore, the establishment of decentralization is mainly related to the extent of the independence of local groups in the exercise of their tasks and competencies entrusted to them, and this can be inferred by knowing the extent of the decentralized authority’s interference in the work of local bodies through what is known as administrative guardianship. Although the majority of constitutions provide for the freedom of local councils to satisfy public needs, the prevailing trend is to grant the custodians a wide discretionary power to exercise guardianship, especially when it comes to the local council as a whole, which we will try to explain by comparing the behavior of the Algerian and Tunisian legislators.
