المستخلص: تعد الرقابة على دستورية القوانين إحدى أهم الوسائل اللازمة لضمان نفاذ القواعد الدستورية، وتحقيقا لهذا الهدف تقرر أغلب الدساتير المقارنة للقضاء حق النظر في دستورية التشريعات والحكم بمطابقتها للدستور من عدمه. ونظرا لخطورة آثار هذه الرقابة كونها تترتب على الحكم بعدم دستورية نص تشريعي إلغاء هذا النص أو وقف قوة نفاذه أو الامتناع عن تطبيقه، فإن معظم الدساتير التي تقرر الرقابة القضائية على دستورية التشريعات تحيط الآليات اللازمة لأدائها بقيود وضمانات قانونية معينة. من هذه القيود والضمانات ما يتعلق بالإجراءات التي تتبع لإصدار الحكم الدستوري، ابتداء ببيان كيفية اتصال المحكمة بالدعوى، إلى الآثار التي تترتب على النص التشريعي المطعون في دستوريته، وكذلك بيان هل أن الحكم بعدم دستورية نص تشريعي يكون له أثرا رجعيا أم فوريا. وعليه فإن بحثنا في هذه الدراسة يشمل الإجراءات المقررة لإصدار الحكم الدستوري مع حجيته، بالإضافة إلى أثار الحكم الصادر بعدم دستورية نص تشريعي لدى كل من المحكمة الدستورية العليا في مصر وسورية والمحكمة الاتحادية العليا في أمريكا.

Monitoring the constitutionality of laws is one of the most constitutional rules, and to this end most of the comparative constitutions of the judiciary decide the right to consider the constitutionality of legislation and to rule whether or not they conform to the constitution. In view of the seriousness of the effects of this oversight, as it entails the ruling that an unconstitutional text should cancel this text, stop its enforceable power, or refrain from applying it, most constitutions that decide judicial oversight of the constitutionality of legislation surround the mechanisms necessary to perform it with certain legal restrictions and guarantees. Some of these restrictions and guarantees relate to the procedures followed for the issuance of the constitutional ruling, starting with stating important means necessary to ensure the enforcement of how the court relates to the case, to the implications of the legislative text contesting its constitutionality, as well as showing whether the ruling on the unconstitutionality of a legislative text has a retroactive or immediate effect. Accordingly, our research in this study includes the procedures established for issuing the constitutional ruling along with its authenticity, in addition to the effects of the ruling on the unconstitutionality of a legislative text with both the Supreme Constitutional Court in Egypt and Syria and the Federal Supreme Court in America.
