المستخلص: إن مسألة إثبات الملكية العقارية وتنظيمها يشكل عائقا رئيسيا، وإشكالا عويصا يواجه الجهات المشرفة على تنظيم الملكية العقارية والمنازعات المثارة بشأنها، ومما لا شك فيه أن الوثائق الناجمة عن عملية المسح لها أثر مهم في تحديد وضبط الملكية العقارية، وذلك بعد تسليم سند يثبت الملكية يكون هو الأثر الناتج عن هذه العملية. هذا وإن مسألة إثبات الملكية العقارية تتطلب تتدخل جهات إدارية معينة للقيام بإجراءات قانونية، لتمكين المعنيين من سند يثبت ملكيتهم، وتدخل الجهات القضائية المختصة للبت في الإشكالات والمنازعات المثارة في هذا الشأن، والتي من أهمها منازعات الترقيم المؤقت.

Le Sujet de l’affirmation de la propriété foncière. La Régulation du sujet de l’affirmation de la propriété foncière rencontre des obstacles, et des embarras devant les autorités compté tentes sur les documents résultants du cadastre, ont une grande importance dans la détermination de leur propriété foncière. Le sujet d’affirmation de la propriété foncière exige une intervention des autorités administrations pour permettre au concernés d’avoir un acte qui prouve leur propriété, les autorités judicaires spécialisés prend les décisions convenables, surtout les litiges d’immatriculation provisoire.

Proving and regulating real estate ownership constitutes a major obstacle and a severe problem facing the authorities supervising the regulation of real estate ownership and the disputes raised about it. Undoubtedly, the documents resulting from the survey process have an important impact in determining and controlling real estate ownership after delivering a document proving ownership that is the effect of this process. The issue of proving real estate ownership requires the intervention of certain administrative bodies to carry out legal procedures, to enable those concerned with a document proving their ownership, and the intervention of the competent judicial authorities to decide on the problems and disputes raised in this regard, the most important of which are disputes of temporary numbering.
