المستخلص: En vue d’assurer l’efficacité de la commande publique et la bonne utilisation des fonds publics, les marchés publics doivent respecter les principes de liberté d’accès à la commande publique, d’égalité de traitement des candidats, et de transparence des procédures. De ce fait, les législateurs Algériens et Tunisiens ont essayé de mettre sur pied plusieurs commissions, parmi lesquelles on trouve la commission communale des marchés publics, qui se distingue par un système juridique spécial de point de vu composition et attributions. Le présent papier présente les principaux outils prévus pour le contrôle des marchés publics au niveau communal, à travers lequel, on peut constater qu’il existe plusieurs points pris en compte par les deux législateurs Algériens et Tunisiens pour protéger les fonds publics.

في إطار الرقابة الإدارية على الصفقات العمومية، أنشأ كل من المشرعين الجزائري والتونسي لجان خاصة بالرقابة، منها اللجنة البلدية للرقابة على الصفقات العمومية، تتميز هذه اللجنة بنظام قانوني خاص، سواء من حيث التشكيلة أو من حيث المهام، وتمثل اللجنة البلدية مركز اتخاذ القرار فيما يخص منح التأشيرة التي هي أحد أدوات حماية المال العام. من هذا المنطلق يقدم هذا المقال مقارنة للنظام القانوني للجنة البلدية بالجزائر وتونس ويبين أهم نقاط التشابه والاختلاف من حيث التشكيلة والاختصاص وقواعد سير عملها، لتبيان مدى فعالية كل لجنة في جدية الرقابة ومدى قدرتها على حماية المال العام.

Within the framework of administrative control over public transactions, both Algerian and Tunisian legislators have established special oversight committees, including the Municipal Committee for the Supervision of Public Transactions. This committee is characterized by a special legal system, both in terms of composition and in terms of functions. The Municipal Committee is the decision-making center for granting a visa, which is a tool to protect public money. From this point of view, this article provides a comparison of the legal system of the Municipal Committee in Algeria and Tunisia and shows the most important similarities and differences in terms of composition, competence, and rules of operation to show how effective each committee is in the seriousness of control and its ability to protect public money.
