المستخلص: تعد حرية التجمع من الحريات الفكرية التي أقرتها المواثيق الدولية وكرستها الدساتير لاسيما الدساتير المغاربية منها الدستور الجزائري والتونسي، حيث اعترفت كل من الجزائر وتونس في قوانينها بممارسة هذه الحرية للأفراد والأحزاب السياسية على حد السواء وذلك كآلية تمكنها من ممارسة نشاطاتها السياسية، وتخضع الأحزاب السياسية عند ممارسة حرية الاجتماعات لرقابة الإدارة حيث تتخذ هذه الأخيرة إجراءات يجب على الحزب إتباعها وأخرى تعد بمثابة سلطات منحت لهيئات الضبط بغرض تنظيم ممارسة هذه الحرية.

La liberté de réunion des libertés intellectuelle approuvées par les conventions internationales et con sacres dans les constitutions,en particulier les constitution du Maghreb compris le constitution de l’Algérie et la Tunisie,ou l’Algérie et la Tunisie dans leur législationd’exercer cette liberté pour l’individus et les parties politiques reconnus aussi bien tant que mécanisme pour leur permettre d’exercer leurs activités politiques, et sont soumis aux partis politiques a l’exercice la liberté des réunions pour contrôlerl’administration lorsque celle-ci prendre des mesures a la partie doit être suivie et l’ autre sert les pouvoirs confères aux organes de control afin de réglementer l’exercice de cette liberté.

Freedom of assembly is intellectual freedom approved by international instruments and enshrined in constitutions, especially the Maghreb constitutions, including the Algerian and Tunisian constitutions. Algeria and Tunisia have recognized in their laws the exercise of this freedom to individuals and political parties alike as a mechanism to enable them to exercise their political activities. When exercising freedom of assembly, political parties are subject to management control. The latter takes measures that the party must follow and others that serve as powers granted to the control organs in order to regulate the exercise of this freedom.
