المستخلص: إن موضوع الحماية الجنائية الدولية للمقدسات الدينية له أهمية كبيرة لما لهذه المقدسات بوصفها موضوعا للحماية من أهمية تتمثل في التأثير الإيجابي الذي تتركه هذه الأخيرة في المجتمعات المحيطة بها، وذلك لارتباطها الوثيق بمعتقدات تلك الشعوب. وعلى هذا الأساس أدرك المجتمع الدولي الأهمية البالغة للمقدسات الدينية على اعتبار أنها تراث مشترك للإنسانية جمعاء، فجرم الأفعال التي تشكل اعتداء على المقدسات والرموز الدينية سواءا كانت هذه الأفعال تخريبا أو إتلافا أو تدنيسا أو سرقة على مستوى الاتفاقيات والمعاهدات الدولية في هذا المجال. وعلى هذا الأساس لابد من تعزيز الآليات القانونية الدولية الخاصة بحماية المقدسات الدينية من حيث اعتبارها ذخيرة الحضارات وسجلها المحفوظ، وهذا لن يتحقق إلا بتشجيع حرية ممارسة الشعائر الدينية ابتداءا، باعتبار أنها تندرج ضمن حقوق الإنسان التي تكفلها الاتفاقيات والمعاهدات الدولية.

Le sujet de la protection pénale internationale des saintetés religieuses est d'une grande importance, en raison de comme ces lieux saints sont un thème de protection ont d'importance envers leurs impact positif que celui-ci laissent sur les communautés environnantes et pour leurs étroite association avec les croyances de ces peuples. Sur cette base, la communauté internationale a reconnu l'importance critique des saintetés religieuses au motif qu'elles sont le patrimoine commun de toute l'humanité, donc il a criminalisé les actes qui constituent un assaut sur les saintetés et les symboles religieux, que ces actes de sabotage ou d'endommager ou de profanation ou de vol au niveau des conventions et traités internationaux dans ce domaine. Sur cette base, il est nécessaire de renforcer les mécanismes juridiques internationaux concernant la protection des sanctuaires religieux parce qu’ils sont considérés comme un des munitions des civilisations et leur fiche sauvegardée, et cette réalisation ne sera d’abord que par l’encouragement de la liberté de la pratique religieuse, comme elle tombe dans les droits de l'homme qui sont garantis par les conventions et traités internationaux.

The subject of international criminal protection of religious sanctities is of great importance because of the importance of these sanctities, as a subject of protection, which is the positive impact that the latter leaves on the surrounding societies, due to their close connection with the beliefs of those peoples. On this basis, the international community realized the critical importance of religious sanctities as a common heritage of all humanity, and criminalized acts that constitute an assault on religious sanctities and symbols, whether these acts were sabotage, destruction, desecration or theft at the level of international conventions and treaties in this field. On this basis, it is necessary to strengthen the international legal mechanisms for the protection of religious sanctities in terms of considering them the repository of civilizations and their preserved record, and this will only be achieved by encouraging the freedom to practice religious rites from the outset, given that they fall within the human rights guaranteed by international conventions and treaties.
