|a ولما كان العرف هو لب حياة الناس العملية والحاكم على كثير من التعاملات بينهم، ولما كانت أعراف الناس متغيرة تبعاً لتغير الزمان والمكان، مما يؤثر على التطبيقات الفقهية المختلفة، فقد آثرت أن أبحث مدى تأثير هذه الأعراف على المهور مما أدى إلى عزوف الشباب عن الزواج. هدف الدراسة أنها تتناول قضية مهمة وهي قضية عزوف الشباب عن الزواج بسبب المهور وأثر الأعراف على ذلك، بما أن العزوف ظاهرة من الظواهر التي تهدد مجتمعاتنا من الداخل، وتأخر في بناء المجتمع، أو توقفا عن البناء فيه، وبالتالي يودي إلى انهياره، وإن كان في قمة الرخاء الاقتصادي والاجتماعي. تبين هذه الدراسة الأحكام التي مرجعها العرف يمكن أن تتغير بتغير هذا العرف كما أنني ومن خلال البحث والتقصي، وجدت أن هناك الكثير من الأعراف منها الصحيح، ومنها الفاسد، لها تأثير على الشباب من خلال هذا البحث، وقد رأيت أنه من الضروري الوقوف عليها وبيان أثرها، في توعية الناس بضرورة محاربة ما يخالف الشرع من هذه الأعراف. وقد بينت في البحث مفهوم العرف، وعلاقته بالمهور، ثم تحدثت عن العرف عند الأصوليين وأثره في الأحكام الشرعية، موقع العرف من مصادر التشريع بناء الأحكام على العرف عند الفقهاء، والأعراف، التغالي في المهر وأثره على الشباب، الأثار الاجتماعية السلبية للعزوف عن الزواج على المجتمع. وتكمن المشكلة الرئيسية للدراسة في السؤال الرئيسي: ما مدي تأثير العرف الاجتماعي على عزوف الشباب عن الزواج. وأهم التوصيات التي وضعت: أولا: الدعوة إلى مراجعة الأحكام الشرعية التي مرجعها العرف والنظر في مواكبتها للمستجدات. ثانيا: دعوة علماء الأمة وأولياء الأمور بتغير بعض الأعراف والعادات التي تقف حجر عثرة في زواج الشباب. ثالثا: تشجيع وسائل الأعلام وشبكات التواصل الاجتماعي في نشر الوعي بين أفراد المجتمع وتعريفهم بمخاطر العزوف عن الزواج.

|b Custom and its impact on dowries and young people reluctance to marry Whereas custom is at the core of people's practical lives and the dominant of many dealings between them, and whereas people's customs are changing according to the change of time and place, which affects the various jurisprudential applications, I have frequently looked at the impact of these customs on dowries, which led to the reluctance of young people to marry. The study aimed to investigate the important issue of the reluctance of young people to marry because of dowries and the impact of customs, since the reluctance phenomenon is a phenomenon that threatens our societies from within, and delayed in the formation of the community, or stop forming it, and thus lead to its collapse even if it is on top of Economic and social prosperity. This study shows the provisions that are related to custom and can be changed by changing this custom. Also, through research and investigation, I found that there are many customs, including the corrupt ones, that have an impact on young people through this research, and I have found it necessary to study them and show their impact, in educating people about the need to fight what violates the law of these customs. I have explained in the research the concept of custom, and its relationship with dowries, and then talked about custom from the viewpoint of fundamentalists and its impact on the legal provisions, the attitude of custom from sources of legislation, and building judgments on custom from scholars' point of view, and customs, overvaluation in the dowry and its impact on young people, negative social effects of abstinence from marriage on the society. The main problem of the study lies in the main question: How much impact does social custom have on the reluctance of young people to marry? The most important recommendations are: First: Calling for reviewing the Shariah provisions that are related to custom and considering their compliance with the latest developments. Second: Inviting the nation's scholars and parents to change some customs and traditions that stand in the way of youth marriage. Third: Encouraging the media and social media in spreading awareness among members of the society and introducing them to the dangers of abstaining from marriage.
