|b The EU-Turkey Deal is a central reaction to the 2015 flight-migration into Europe. In the context of the Deal, the boundary between voluntariness and force is blurred, forming the condition of possibility of expulsion. The overlapping of two different forms of migration management approaches, the EU-Turkey Deal and the Assisted Voluntary Return and Reintegration Programme create a grey zone of indistinction. Within this grey zone, access to rights is systematically made impossible. “Voluntary return” enables the bypassing of legal guarantees certified by the Geneva Refugee Convention drawing on the paradigm of alleged individualized freedom of choice. The central effect of this grey zone is the lack of accountability of any agency participating in the deportations labelled as voluntary.

|d L’accord UE-Turquie est une réaction centrale à la migration vers l’Europe de 2015. Dans le contexte de l’accord, la frontière entre la dimension volontaire et la coercition est floue et constitue la condition de la possibilité d’expulsion. Le chevauchement de deux formes différentes d’approches à la gestion des migrations, l’accord UE-Turquie et le programme d’aide au retour volontaire et à la réintégration, crée une zone grise d’indistinction. Dans cette zone grise, l’accès aux droits est systématiquement rendu impossible. Le «retour volontaire» permet de contourner les garanties juridiques certifiées par la Convention de Genève sur les réfugiés en s’appuyant sur le paradigme de la prétendue liberté de choix individuel. L’effet centrale de cette zone grise est l’absence de responsabilité des agences participant aux expulsions étiquetées comme étant volontaires.
