المستخلص: يطرح هذا البحث مشكلة التعرف على مدى إسهام اللجنة المكلفة بتعديل الدستور الجزائري لسنة 2020، في ترقية الوثيقة الأساسية للدولة فيما يخص ممارسة حقوق وحريات الأفراد بتكريس ضمانات فعلية للانتقال بها إلى الواقع العملي. وقد كشفت أن بعض مقترحات اللجنة قد تساهم في تعزيز ضمانات حقوق وحريات الأفراد الذي يعد أهم معالم دولة القانون، فرغم بعض التعثرات إلا أن أغلب الإضافات المقترحة جاءت في إطار تحسين مضمون القواعد الدستورية المتعلقة بالحقوق والحريات وضماناتها، حيث تجاوبت اللجنة مع المطالب الحقوقية بشكل كبير إما بتعزيز شروط ممارسة بعض الحقوق والحريات المقررة في الدستور الحالي أو بطرح حقوق وحريات أخرى وإقرار ضماناتها، بينما قد يشكل عدم الدقة في طرح بعض القواعد وعدم وضوخ صياغتها، في إفراغا وهدرا لجوهرها، ما يعكس الرغبة في استمرارية السياق القانوني لما قبل هذا التعديل، فالمقترحات لم تكن عميقة ولم تكن دقيقة ومضبوطة. وانتهت إلى القول بضرورة العناية بصياغة القواعد الدستورية المتعلقة بحقوق الأفراد وحرياتهم وتقديم توصيات لإثراء المسودة.

This stady presents the problem of identifying the extent of the contribution of the committee in charge of amending the Algerian constitution for 2020 to upgrading the basic document of the state with regard to exercising the rights and freedoms of individuals by devoting effective guarantees to move it into practice. The recherche revealed that revealed that some of the committee’s proposals may contribute to strengthening guarantees of the rights and freedoms of individuals, which is the most important feature of the state of law. By strengthening the conditions for exercising some of the rights and freedoms set forth in the current constitution or by proposing other rights and freedoms and approving their guarantees, while the inaccuracy in proposing some rules and the lack of clarity in drafting them may constitute a void and a waste of its essence, which reflects the desire to continue the legal context prior to this amendment, the proposals did not It was deep and was not accurate and accurate. The study concluded that it is necessary to take care of drafting the constitutional rules related to the rights and freedoms of individuals and making recommendations to enrich the draft.
