520 |a تناولت الدراسة علاقة العادة بالعبادة من حيث المنطلقات والنتائج المترتبة على التمييز بينهما، وحاولت إجراء مقابلة بين ما يعد من العبادات وبين ما هو من العادات للمساعدة في تصنيف المستجدات وما يترتب عليها من أحكام واجتهادات، وبينت الضوابط التي تؤدي إلى هذا الفصل الواضح بين ما هو توقيفي محض لا يقبل الاجتهاد كالعبادات، وبين ما يدور مع علته حيث كان وفق ضوابط العادات. وخلصت إلى أن الشريعة تشتمل على التوقيفي الذي لا يسع أحدا الاجتهاد فيه، وبين ما هو تعليلي يقبل الاجتهاد والتجديد وفق مستجدات ومتغيرات الزمان والمكان وهو الأغلب، وبناء على هذه المقاربة يتضح جانب من مفهوم البدعة وعلى ماذا يطلق، بالإضافة إلى بروز مكانة العادة في التشريع وأثرها في اجتهادات الفقهاء، وقد تطرقت الدراسة لعلاقة العادة بالعرف وأثر تصنيفهما في استنباط الأحكام العملية.
