المستخلص: الحمد لله رب العالمين، وأفضل الصلاة وأتم التسليم على نبينا محمد وعلى أله وأصحابه أجمعين. وبعد: فإن مباحث الأمر والنهي من أهم مباحث أصول الفقه، وأعظمها فائدة وأجلها ثمرة علمية؛ فإن بإدراكهما تتم معرفة الأحكام، ويتميز الحلال من الحرام، كما أنه يحصل بهما التكليف والجزاء؛ فالتكليف في الشريعة إما أوامر يراد امتثالها، أو نواهي يراد اجتنابها، وحيث كان من دأب الأصوليين عند الحديث عن الأمر استيفاء البحث في أحكامه وكل ما يتعلق به من صيغة ومقتضى وأقسام وآثار. فقد تم اختيار مبحث الأمر من كتاب جواهر الأفكار على مختصر المنار للبلبيسي كمستله والذي تم من خلاله استيعاب مبحث الأمر بتفصيل مفيد ومتقن، وجواهر الأفكار هو شرح منصور بن أبي الخير البلبيسي لمختصر ابن حبيب الحلبي المتوفى (٨٠٨ه) على كتاب المنار في أصول الفقه لأبي البركات النسفي المتوفى (٧١٠ ه)، وقد تم تحقيق ما يقارب نصفه كبحث مكمل لنيل درجة الماجستير لمعد هذا البحث، والمنهج المتبع في ذلك: المنهج الوصفي في التحقيق والمنهج التحليلي في دراسة النص. وقد تناول مبحث الأمر الحديث عن النقاط الآتية: 1-معنى الأمر لغة واصطلاحا. 2-أقسام الأمر باعتبار حالته في نفسه. 3-أنواع الأمر باعتبار الوقت. 4 -الوجوب. ٥ -أنواع الموجب (المقتضى). ٦ -أنواع الأداء. 7 -أنواع القضاء. كما تم تفصيل القول في بعض المسائل: كهل يفيد الأمر التكرار، وهل الكفار مخاطبون بفروع الشريعة حيث بين رأي الأصوليين الحنفية وقارنه برأي الأصوليين الشافعية -رحمهم الله جميعا-.

Praise be to Allah, the Lord of the Worlds, and the best prayer and complete peace on our Prophet Muhammad and his family and companions. And so: The studies of command and prohibition are one of the most important, greatest benefit and best scientific result studies of the Foundation of Islamic Jurisprudence, through recognizing them, many rules could be known. These also show differentiation between Halal and Haram, and cause the requirement of assignment and reward. The Assignment in Sharia is either orders intended to be complied with or intended to be avoided. It was a habit of scholars when discussing a command; they keep completing the research in its rulings, and all that is related to the wording and required sections and effects. So on, the quest of command had been chosen from (Jawahir Al-Afkar) the book of Al-Bilbeesi on (telegraphic of Al-Manar) as a partial quest which was through it the comprehension of the command quest in a well useful detail. (Jawahir Al-Afkar) the book of Al-Bi lbeesi is the summary explanation of Ibn Habeeb -who died in the year (808) of migration- which abridge Al- Manar in Usool Al-Fiqh the book of Abi Al-Barakat An-Nasafi -who died in the year (710) of migration-, almost half of the book has been achieved as a thesis to obtain a master's degree for the writer of this research, and the methodology which was followed in the research is descriptive approach in the investigation and analytical approach in the study of the text. The topic of the command discussed the following items: 1. The meaning of the command in the linguistically and terminologically. 2. Sections of the command as its condition is in itself. 3. Types of command in terms of time. 4. Obligation. 5. Types of requirement. 6. Types of performance. 7. Types of quittance. Some issues have been explained in details, like, is it necessary in command to repeat, and are the disbelievers being addressed to apply the pillars of Islam? Where the opinion of the Hanafi scholars was explained and compared to the opinion of the Shafi'i scholars, may Allah have mercy them.
