المستخلص: يخلص هذا البحث ويهدف إلى بيان الآراء الطبية والأحكام الفقهية المتعلقة بالخلايا الجذعية المستخرجة من الحبل السري، وقد اعتمدت المنهج الوصفي التحليلي المقارن، وقد خلصت هذه الدراسة إلى النتائج التالية: الخلايا الجذعية المستخرجة من الحبل السري هي خلايا تستخرج من الحبل السري بعد الولادة، وهي من أنسجة الجسم تستطيع أن تتكاثر وتولد خلايا مشابهة، ومن فوائدها أنها تعطي كافة أنواع الخلايا والأنسجة، وتحل محل الخلايا المصابة أو التي توقفت وظائفها في جسم الإنسان وذلك بطرية الاستزراع الموضعي والحقن الوريدي، وتساهم هذه الخلايا في إعادة بناء خلايا الدم والجهاز المناعي للمرضى المصابين بأمراض الدم، ويعتبر دم الحبل السري أحد المصادر الحيوية الغنية بالخلايا الجذعية مثله مثل نخاع العظم، والدم المحفز لإنتاج الخلايا، ومن مميزات هذه الخلايا أنها أولية، وقادرة علـى التطور إلى أنواع الدم، وأنها لا تهاجم من جهاز المناعة في الجسم، ويمكن الاحتفاظ بها مدة طويلة وقيل يمكن الاحتفاظ بها إلى الأبد كما ذكره بعض الأطباء.
ويمكن لصاحب هذه الخلايا الانتفاع بها، وكذا يمكن لغيره في حال تبرعه بها، كما أن الأدوية المصنعة من هذه الخلايا أكثر فعالية وكفاءة من غيرها، ولا يظهر لي مانع شرعي من استخراج هذه الخلايا من الحبل السري بعد موافقة الوالدين وإذنهما، والاستفادة منها في الأبحاث والعلاج، أما استخدامها في الأدوية ففي حال الضرورة وتعذر التداوي بالمباح إذا غلب على الظن الشفاء بها.
وبملك صاحب هذه الخلايا إذا كان بالغا عاقلا أو وليه الشرعي القائم على ولايته والناظر في أموره بما يعود عليه بالمنفعة الإذن للطبيب في استخدامها للتداوي لنفسه أو وليه، والإذن للأخرين بالتصرف فيها في حال رغبته عنها، ويجوز للمريض شراء الخلايا الجذعية المستخرجة من دم الحبل السري كما يجوز بيع هذه الخلايا إذا كان على وجه يمكن من الانتفاع بها، ولا يجوز المتاجرة بهذه الخلايا عملا بالقاعدة الشرعية سد الذرائع، ولما في ذلك من امتهان أعضاء الإنسان ونسجته، واستغلال حاجته وفقره.


This research concludes and aims to explain medical opinions and Shari rulings on stem cells extracted from the umbilical cord. The study adopted the comparative analytical descriptive approach and reached the following conclusions: Stem cells extracted from the umbilical cord are cells extracted from the umbilical cord after birth. They are part of the body tissues that can reproduce and generate similar cells. Its benefits are that they give all types of cells and tissues, replace infected cells or those which have ceased functioning in the human body by way of local transplantation and intravenous injection. These cells contribute to the reconstruction of blood cells and the immune system of patients with blood diseases. Cord blood is one of the vital sources rich in stem cells like bone marrow, blood that stimulates cell production. One of the characteristics of these cells is that they are primary and capable of developing into blood types and do not attack the body's immune system. They can be retained for a long time, and it has been said that they can be preserved forever, according to some doctors.
The owner of these cells can benefit from them, so can others benefit from them provided that he donates them. The drugs manufactured from these cells are more effective and efficient than others. I could not find any Shari objection to extracting these cells from the umbilical cord after the parents' consent and permission and benefiting from them in research and treatment. However, using them in medicines should be in case of necessity, and when the permissible (treatments) don't cure the disease, and when it is very likely that the patient will be cured (by being treated with stem cells).
The owner of these cells, if he is a sane adult or his legal guardian who looks after his affairs that will bring him benefit, shall have the right to give permission to doctor to use these cells for himself or for his guardian, and allow others use them if he wishes so. The patient may buy stem cells extracted from umbilical cord blood. It is permissible to sell these cells if they can be used. It is not permissible to trade in such cells pursuant to the Shariah rule, which is tying up loose ends, because of the abuse of human organs and tissues and exploiting his needs and poverty.
