المستخلص: الحمد لله رب العالمين والصلاة والسلام على أكرم الأنبياء والمرسلين؛ نبينا مُحَّمد وعلى آله وصحبه أجمعين أما بعد: فقد اختلف علماء الأصول في عدة مسائل، وكان لخلافهم هذا أثر في اختياراتهم الفقهية، كما أن خلافهم كان مستندا إلى أدلة يرون صحتها، ووجاهتها، ويأتي هذا البحث في دراسة إحدى تلك المسائل الخلافية، وهي مسألة: اللفظ المحتمل للحقيقة والمجاز، إذا صدر من شخص واحد في وقت واحد، هل يمكن أن يحمل على المعنيين معا؟ أم لا؟ ذكرت فيه الأقوال والأدلة، وما قد يرد عليها من مناقشة وإجابات، ثم ذكرت بعض المسائل الفقهية المترتبة على هذا الخلاف، وقد جاء البحث في مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة، اشتمل التمهيد على تعريف الحقيقة والمجاز، والفرق بين الوضع والاستعمال والحمل، واشتمل المبحث الأول على تصوير المسألة، وتحرير محل النزاع، والأقوال في المسألة، واشتمل المبحث الثاني على الأدلة والمناقشة والترجيح، كما اشتمل المبحث الثالث على الجانب التطبيقي، الذي أوردت فيه عدة مسائل فقهية، ثم خاتمة البحث التي أوردت فيها أبرز النتائج والتوصيات. وصلى الله وسلم على نبينا مُحَّمد وعلى آله وصحبه.

Praise be to Allah, the Lord of the Worlds and prayers and peace be upon the most noble Prophet and Messenger, Muhammad, as well as his family and his companions. Thereafter, scholars of Islamic Legal Theory differ on various issues, which affect their juristic opinions. Also, their differences are based on evidence that they consider valid and worthy of regard. This research paper looks into one of the differed issues, a word that could convey a literal and metaphorical meaning. If a person states something, is it possible for that person’s uttered word to be per its literal and metaphorical meaning simultaneously or is it not possible? I present the various opinions along with each position’s evidence, arguments, and responses to the opposing opinions and arguments. Afterwards, I mention the effect of these opinions as it relates to some legal issues. The research consists of a preface, an introduction, three sections, and a conclusion. The introduction consists of definitions for "literal" and "metaphorical" and the differences between naming a word, its usage, and its interpretation. Section one presents a conceptualization of the issue at hand, the distinct areas of dispute, and the opinions of each party. Section two presents the evidence of each position, a discussion of each evidence followed by my position on the issue. In section three, I apply the disputed legal theory issue to legal issues. Finally, the conclusion offers the results of the research and suggested areas for further research. We end by asking Allah to send prayers and peace upon our Prophet Muhammad, his family, and his companions.
