المستخلص: يتناول هذا البحث مقاصد الشريعة الإسلامية وأثرها في أحكام الأسرة، وقد جاء في تمهيد، ومبحثين، وخاتمة: في التمهيد: عرفت بمقاصد الشريعة، وتقسيمات مقاصد الشريعة، وبينت طرق الكشف عن مقاصد الشريعة، ومكانة الأسرة في الأسرة. أما عن المبحث الأول: فقد تناولت فيه مقاصد الشريعة الإسلامية في الأسرة، وجاء ذلك في أربعة مطالب: المطلب الأول: حفظ النسل وبقاء النوع البشري، بتشريع عقد النكاح، والمطلب الثاني: حفظ النسب، والمطلب الثالث: تمييز عقد النكاح في الإسلام عن أنكحة الجاهلية وما شابهها، والمطلب الرابع: من مقاصد الشارع استدامة عقد النكاح بين الزوجين، وتحقيق المودة والرحمة. وفي المبحث الثاني تناولت مقاصد الشريعة في آصرة النسب والصهر في الأسرة، وجاء ذلك في ثلاثة مطالب: المطلب الأول: قصد الشارع حفظ نسب الأولاد، والحرص على صلاحهم، والقيام بحقوقهم، المطلب الثاني: قصد الشارع قيام الأولاد بحقوق الوالدين، إظهارا لمحاسن الشريعة، المطلب الثالث: مقاصد الشريعة في آصرة النسب والصهر. وكان من أهم نتائج التي توصلت إليها: أن مقاصد الشريعة في الأسرة شملت كل مكوناتها، ابتداء من الزوجين، واقترانهما ببعضهما، ثم تنظيم حياتهما الزوجية بعد عقد النكاح، ثم العناية بالأولاد وتنظيم كل شؤونهم، ثم العناية بالوالدين والقيام بحقهما، ثم الإحسان إلى الأقارب من النسب والأصهار. أن رابطة الأسرة من أقوى الروابط التي يتكون منها المجتمع، إذ هي تمثل اللبنة الأولى والأساس في تكوين المجتمعات. أن من مقاصد الشريعة في أحكام الأسرة منها ما يعد من الضروريات كالمحافظ على النسل والنسب، ومنها ما يعد حاجيا أو مكملا أو أصليا أو تابعا لهذين المقصدين، على تفاوت في قوتها واعتبار الشارع وملاحظته لها في الأحكام.

This research deals with the purposes of Islamic law and its impact on family rulings. It came in a preamble, two studies, and a conclusion : In the preamble : it was known as the purposes of Sharia, and the divisions of the purposes of Sharia, and showed ways to reveal the purposes of Sharia, and the family’s place in the family. As for the first topic: it covered the purposes of Islamic law in the family, and this came in four demands: the first requirement: the preservation of the offspring and the survival of the human species, through the legislation of the marriage contract, and the second requirement: the preservation of lineage, and the third requirement: distinguishing the marriage contract in Islam from The ignorance of marriage and similar things, and the fourth requirement: one of the intentions of the street is the sustainability of the marriage contract between the spouses, Achieving affection and mercy. In Section II dealt with the purposes of the law in bond rates and smelting in the family, and came in three demands: the requirement first: inadvertently street keeping ratios of children, and to ensure the Slaham, and carry out their rights, demand the second: meant the street by the children 's rights of parents, a manifestation of the virtues of the law, demand Third: The purposes of Sharia in the family of lineage and brotherhood. Among the most important results that I reached: -That the purposes of Sharia in the family included all its components, starting with the two spouses, and pairing them with each other, then organizing their marital life after the marriage contract, then caring for the children and organizing all their affairs, then caring for the parents and doing their right, then charity to the relatives of lineage and in- laws. -The Association of the family of the strongest links that consists of which society, as it is represents a block first basis in the composition of communities. -that the purposes of the law in terms of the family, including what is the necessities Kalmhafez on birth and descent, including what is Hagia or complement or an original or a follower of these Almqsidin, the disparity in power and considering the street and noticed her in the provisions.
