المستخلص: إن عملية تقسيم الدولة إلى دوائر انتخابية، تمثل أهمية كبري للعملية الانتخابية، سواء أجريت الانتخابات بموجب نظام الانتخاب الفردي أو الانتخاب بالقائمة وهو وضوح لابد من حسمه قبل الانتخابات، فالدائرة الانتخابية لا تخرج عن كونها وحدة انتخابية قائمة بذاتها، يتيح فيها المشرع للناخبين المقيدين في السجل الانتخابي، انتخاب ممثل لهم أو أكثر في المجلس النيابي يدافع عن مصالحهم ويمثل رؤيتهم للنظام السياسي، وفي جميع الأحوال عند تقسيم الدولة إلى دوائر انتخابية لا بد أن يؤخذ بالاعتبار عدد السكان في كل دائرة انتخابية، بحيث يكون هناك تناسب بين عدد المقاعد وعدد السكان في كل دائرة انتخابية، بحيث لا تكون الدائرة صغيرة مما يؤدي إلى زيادة عدد النواب في البرلمان بغير ضرورة أو حاجة، الأمر الذي ينعكس سلبا على العمل البرلماني وقد يعطل الممارسة الديمقراطية، وعلى العكس لا يصح أن تكون الدوائر كبيرة جدا مما يقلل من التمثيل في البرلمان وتهميش بعض الناخبين. وهذا التقسيم لا يعني أن كل دائرة انتخابية جزء مستقل أو منفصل عن الدولة، وإنما هو تقسيم إداري مرجعيته القانون ومنطلقاته الدستور، ولم يراع المشرع الفلسطيني والسلطة التنفيذية سواء في الانتخابات التشريعية الأولى 1996 أو الثانية 2006 المبادئ العامة في تقسيم الدوائر الانتخابية وبالتالي وهو ما انعكس على العدالة في التمثيل بين الدوائر الانتخابية والمساواة بينها، كما أن المشرع الفلسطيني أغفل مسألة الرقابة القضائية لعملية تقسيم الدوائر الانتخابية وتوزيع المقاعد البرلمانية لكل منها وهو أمر بالغ الأهمية في الانتخابات.

It is clear that it must be resolved before the elections. The electoral constituency is no more than a stand-alone electoral unit. The electoral register, the election of one or more representatives in the House of Representatives who defend their interests and represent their vision of the political system. In all cases, when the state is divided into electoral districts, the number of inhabitants in each electoral district must be taken into account, so that there is a proportion between the number of seats and the number of inhabitants in each electoral district, so that the constituency is not small, Or need, which is reflected negatively on parliamentary work and may disrupt the practice of democracy, and on the contrary can not be very large circles, which reduces representation in parliament and the marginalization of some voters. This division does not mean that each constituency is an independent or separate part of the state. It is a division of administrative reference law and the principles of the Constitution. The Palestinian legislator and the executive authority did not observe the general principles of the division of constituencies in the first legislative elections of 1996 or 2006, Justice in the representation between the constituencies and equality between them, and the Palestinian legislator overlooked the issue of judicial control of the process of division of electoral districts and the distribution of parliamentary seats each of which is very important in the elections.
