بسم الله الرحمن الرحيم، إن النظر في المآلات ينبني عليه كثير من الأحكام لدى المجتهد لاسيما ما كان منها متعلقا بالنوازل والمستجدات وأبواب الفقه الافتراضي أو التوقعي، وتظهر مشكلة هذه الدراسة في كون عدم النظر في المآلات يوقع في مزالق كثيرة ويؤدي إلى خطأ في الفهم وتنزيل الأحكام في غير مسارها مما يحدث إشكاليات كبرى ليس على مستوى الفروع الفقهية فحسب بل على مستوى الإفتاء أيضا ويؤدي إلى ضياع المصالح والوقوع في المفاسد، وقد اقتضدت الدراسة تقسيمها إلى: مقدمة وتمهيد وخمسة مباحث وخاتمة، اشتملت المقدمة على الأهمية، والأسباب، والمنهج، والخطة. وجاء التمهيد مشتملا على تعريف المآل والفتوى، وعلاقة المآل بالأمور ذات الصلة، ثم جاء المبحث الأول مشتملا على أدلة اعتبار المآل، والثاني تناول ضوابط اعتبار المآل، والثالث شروط اعتبار المآلات، والرابع فقد اشتمل على أمور ينبغي للمفتي مراعتها، واحتوى المبحث الخامس على نماذج تطبيقية. وقد جاء هذا البحث إظهارا لمرونة الإسلام وصلاحيته لكل زمان ومكان وأنه مواكب للمتغيرات والنوازل والمستجدات.
In the name of God, the Most Gracious, the Most Merciful. Consideration of the consequence is important as many Islamic jurist's judgments are based upon it, especially what were related to the new difficulties and novelties and the chapters of hypothetical or expectant jurisprudence. This study is highly important as not paying care to the consequences causes major problems, misunderstanding, and not putting the judgments in the correct way. Accordingly, many difficulties may occur not only at the level of doctrinal branches but also at the level of advisory opinion and lead to loss of interests and falling into spoilage. The study comes into two divisions: an introduction and foreword and five topics and a conclusion. The introduction included the importance, and the reasons, syllabus, and plan. The foreword included the definition of consequence and fatwa and the relationship of consequence to the relevant matters. Then, the first topic included the evidence for the consideration of consequence. The second dealt with the controls of consequence consideration. The third dealt with conditions for consideration of consequence. The fourth included matters that the Mufti should take into account. The fifth contained applied models. This research came to show the flexibility and validity of Islam for every time and place and that it keeps pace with changes, novelties, and developments.
