|a من أهم ما شرع الله تعالى لضمان التعامل السليم بيننا أحكام الشهادات، وقد شرع سبحانه لنا الإشهاد على العقود للاستيثاق ونبذ المنازعات، وتعتبر الأحوال الشخصية من المجالات الحساسة التي كثيراً ما يقع بسببها النزاع وهضم الحقوق، ومن ذلك الرجعة والطلاق، وقد اختلف الفقهاء في حكم الإشهاد عليهما لعدم وجود نص قاطع في الموضوع، فيأتي هذا البحث ليتناول اختلاف الفقهاء في ذلك مع بيان مستند كل فريق، باعتبار الرجعة والطلاق من الأمور التي تعم بها البلوى في الواقع والتي تترتب عليها حقوق مادية ومعنوية.

|b The most important of what Allah ruled to insure the right dealing between us are the testimonies decrees, and His Holiness Praise to Him ruled for us the testimony on the contracts to reject the wrangles; and the individual statuses are considered as sensitive fields that often causes the argument and the offence of rights, such as the regress and divorce that the legists disagreed in certifying on them, because of the absence of a decisive formula on the subject; thus, the quest is to consider the legists disagreement on the testimony with a document of each team; considering the regress and divorce the matters by which the affliction spread in reality and that necessitate concrete and moral rights.
