المستخلص: يتناول هذا البحث موضوع الدليل الإلكتروني لإثبات الجريمة الإلكترونية وإجراءات جمعه، سواء أكانت تلك الإجراءات تقليدية أم حديثة، ويكتسي هذا الموضوع أهمية متزايدة في ضوء التطورات التقنية المتراكمة والسعي المحموم من قبل المجرمين لتوظيف ذلك في جرائمهم، وكذلك بسبب ظهور مجالات إلكترونية جديدة ممثلة بساحات ووسائل التواصل الاجتماعي، مما يطرح تحديات عدة خاصة في مجال الجرائم الإلكترونية التي لا تزال في عداد الجرائم الأكثر صعوبة في مجال الإثبات الجنائي، بسبب المتطلبات الفنية والقانونية في هذا المجال.
ويهدف هذا البحث إلى بيان خصوصية وطبيعة الدليل الإلكتروني في ضوء التطورات التي شهدها الدليل الإلكتروني سواء في المجال الفني أو في مجال المشروعية والتقنين، حيث يعرض لموقف تشريعات مقارنة واجتهادات فقهية عدة فيما يتعلق بإجراءات جمع وتمحيص وتنظيم هذا النوع من الأدلة. وقد اعتمد الباحث على المنهجين الوصفي والمقارن لرصد الإشكاليات التي يثيرها هذا الموضوع، مع تحليل الأنظمة والتطبيقات التي تقدمها التشريعات والاجتهادات المختلفة وبيان أوجه النقص أو الثغرات التي تعتريها.
وقد خلص البحث إلى عدة نتائج من بينها تأكيد التطورات الفنية والقانونية الجارية على الطبيعة الخاصة للجرائم الإلكترونية التي تميزها عن مختلف الجرائم سواء من حيث الوسائل التي ترتكب بها أم من حيث المحل الذي تقع عليه، وكذلك من حيث الجناة الذين يرتكبون هذه الجرائم. ومن هذه النتائج أيضا هو أن سلطات التحقيق لا تزال تواجه العديد من الصعوبات في مجال الإثبات الجنائي للجريمة الإلكترونية وإجراءاتها. ولذلك فقد أوصى البحث بضرورة مواكبة التطور التقني الحاصل بإدخال وسائل وطرق حديثة للكشف عن الجرائم والحصول على الأدلة التي تتناسب وطبيعتها الخاصة، وهو ما سيسمح لرجال البحث والتحري بالقيام بمهامهم على أكمل وجه.


This research deals with the subject of the electronic evidence to prove cybercrime and the procedures for collecting it, whether traditional or modern, and this subject is increasingly important in the light of the accumulated technical developments and the frantic pursuit by criminals to employ this in their crimes, as well as because of the emergence of new electronic areas represented by domains and social media, which poses several challenges, particularly in the area of cybercrime, which remains one of the most difficult crimes in the field of criminal proof, due to technical and legal requirements in this Domain.
This research aims to demonstrate the specificity and nature of the electronic guide in the light of developments in the electronic manual, both in the technical field and in the field of legality and legalization, where it presents the position of comparative legislation and extrapolated jurisprudential laws in relation to the procedures for collecting, scrutinizing and regulating this type of evidence. The researcher relied on the descriptive and comparative approaches to monitoring the problems raised by this subject, analyzing the systems and applications provided by different legislations and jurisprudence, and identifying the shortcomings or gaps they experience.
The research has found several findings, including confirmation of ongoing technical and legal developments in the particular nature of cybercrime that distinguish it from various crimes, both in terms of the means committed and in terms of the place where it is located, as well as in terms of the perpetrators who commit such crimes. One of these findings is that the investigating authorities continue to face many difficulties in the criminal proof and procedures of cybercrime. Therefore, the research recommended that the technical development should be kept upto date with the introduction of modern methods and methods of detecting crimes and obtaining evidence commensurate with their unique nature, which would allow the research and investigation personnel to carry out their tasks to the fullest.
