يهدف هذا البحث إلى: ١- معرفة الحكم الشرعي لنوازل الوقف ومسائله الحادثة. ٢- توسيع دائرة الوقف بما يتوافق مع النصوص ومقاصد الشريعة. ٣- الوقوف على ما فيه نص صحيح صريح من شروط الوقف، وما كان خلاف ذلك. ٤- ذكر عدد من الصور المعاصرة للأوقاف، ومعرفة مشروعيتها. وقد قسمت البحث إلى: مقدمة، وثلاثة مباحث، وخاتمة. المقدمة: وقد اشتملت على أهمية الموضوع، وذكر الدراسات السابقة، ومنهج البحث، وخطته. المبحث الأول: تعريف الوقف ومشروعيته، وتحته مطلبان: - المطلب الأول: تعريف الوقف. - المطلب الثاني: مشروعية الوقف. المبحث الثاني: ما تميز به مذهب المالكية عن المذاهب الثلاثة في شروط الوقف وتحته مطلبان: - المطلب الأول: التعريف بمذهب المالكية. - المطلب الثاني: ما تميز به مذهب المالكية عن المذاهب الثلاثة في شروط الوقف. المبحث الثالث: أثر شروط الوقف عند المالكية على شرعية الأوقاف المعاصرة، وتحته أربعة مطالب: - المطلب الأول: شروط الوقف المتعلقة بصيغة الوقف، وأثرها على شرعية الأوقاف المعاصرة. - المطلب الثاني: شروط الوقف المتعلقة بالواقف، وأثرها على شرعية الأوقاف المعاصرة. - المطلب الثالث: شروط الوقف المتعلقة بالموقوف عليه، وأثرها على مشروعية الأوقاف المعاصرة. - المطلب الرابع: شروط الوقف المتعلقة بالموقوف، وأثرها على شرعية الأوقاف المعاصرة. ثم ختمت البحث بخاتمة، بينت فيها أهم ما توصلت إليه، ثم ختمت ذلك بفهرس المراجع، وفهرس الموضوعات.
This research aims to: 1- Knowing the legal judgment on endowment calamities and its current issues. 2- Expanding the endowment field in accordance with the texts and the purposes of Sharia 3- Highlighting what is a true and clear text of the conditions of endowment, and what is otherwise. 4- Mentioning a number of contemporary examples of endowments, and knowing their legality. The research has been divided into: an introduction, three sections, and a conclusion. Introduction: It included the importance of the topic, mentioned the previous studies, the research methodology, and its plan. The first section: Definition of endowment and its legality. It has two requirements: - The first requirement: the definition of Endowment. - The second requirement: the legality of Endowment. The second section: What distinguished the Maliki school among thoughts from the three schools in regards to endowment conditions. This section has two requirements below it: - The first requirement: introducing the Maliki school of thought. - The second requirement: What distinguished the Maliki school among thoughts from the three schools of endowment conditions. The third section: The impact of the Malikis ’endowment conditions on the legitimacy of contemporary endowments. This section has four requirements: - The first requirement: the conditions of the endowment related to the form of endowment, and their impact on the legitimacy of contemporary endowments. - The second requirement: the endowment conditions related to the endowment, and their impact on the legitimacy of contemporary endowments. - The third requirement: the endowment conditions related to the endowed-to person, and their impact on the legitimacy of contemporary endowments. - Fourth requirement: the endowment conditions related to the endowed-from person, and their impact on the legitimacy of contemporary endowments. The research was concluded with a conclusion which explains the most important findings, then the reference list and the index of subjects.
