المستخلص: إن الله سبحانه وتعالى قد حفظ للناس أمر دينهم ودنياهم، وشرع لهم من الأحكام والتشريعات ما يحفظ بهم أرواحهم ونفوسهم وأبدانهم، فإن للنفس في الشريعة الإسلامية حقوقا عظيمة حال حياتها وبعد مماتها. وبينت في بحثي أن الأصل في العقوبة أن تكون على الجاني بقدر جنايته، ولا يتحملها عنه غيره إلا في بعض الصور، وخاصة فيما يتعلق بباب الديات فإن النصوص الشرعية دلت على اختلاف تحمل الدية باختلاف الجاني وصور جنايته، فهناك من الديات ما يتحملها الجاني وحده، ومنها ما يتحملها عصبة الجاني وهم عاقلته، ومنها ما يتحمله بيت مال المسلمين، وقمت بجمع ما تيسر لي من أحكام الديات التي يتحملها بيت مال المسلمين، ومن مهام البحث وأغراضه المعروفة جمع ما تفرق وضم النظير إلى نظيره وبيان ما أشكل، وهو ما حاولت فعله في بحثي هذا، فقد حاولت جاهدا أن أجمع كل ما نص الفقهاء رحمهم الله عليه في كتاب الديات على تحمل بيت مال المسلمين له، وإن كانت المسائل فيه قليلة فهي التي وجدتها ولم آل جهدا مع الصعوبة في ذلك. فتوصلت إلى أن بيت مال المسلمين يتحمل من الديات ما يعجز عنه المكلف أو يكون الأمر مرتبطا بجهالة القاتل وغير ذلك مما يكون حفظا لحق المقتول وأوليائه من بعده كما بينته في ثنايا البحث.

Among the tasks of the research and its well-known purposes is to collect what was divided and join the peer to its counterpart, and to clarify what was formed, which is what I tried to do in this research. They are few that I found and I did not struggle with the difficulty. So I concluded that the house of Muslim wealth bears from the blood money that the responsible person is unable to do, or the matter is related to the ignorance of the killer and other things that are to preserve the rights of the murdered and his relatives after him, as I showed in the folds of the research.
