|b The appearance of SARS-COV 2 at the end of 2019 in China, before its wide-spreading in the majority of countries of the world, has subverted the usual and ordinary of the inside and outside movement notably in the states of Eastern-Asia, Western-Europe and North-America. Morocco, North African country, was not kept safe of this pandemic (1st case was on the 2nd March 2020) and had to react quickly by taking, under the high instructions of His Majesty Mohamed the sixth (May GOD assist him) proactive measures in order to restrain the spread of the virus and to save the health of citizens despite the negative effects on economics, such as: closing the borders, creating a special fund to face sociably and economically the impact of the epidemic…etc. The public health emergency has been declared and governors should enact laws to manage this sudden situation. In the middle of this crisis, the professionals of health who are found in the first rang of the battle have shown courage and patriotism unprecedented. Their support, their encouragement and their protection seem a bet not to lose inside an obsolete and fragile system of health. In this article, I will attempt to answer the questions: how was the impact of the state of health emergency on the production of legal rule? As well, how the legislation existed assure the protection of health care providers who are in the first line of combating the Coronavirus? Once we know these aspects, we can begin to trace the big lines of challenges and reforms needed to make the health system better.

|d L’apparition de SARS- Cov 2 fin 2019 en Chine, avant sa propagation à la majorité des pays du monde, a bouleversé la marche habituelle et ordinaire du mouvement interne et externe notamment dans les pays de l’Asie-Est, l’Europe-West et l’Amérique-Nord. Le Maroc, pays nord-africain, n’était pas àl’abri de cette pandémie (1er cas le 2 mars 2020) et a dû réagir promptement en prenant, sous les Hautes Directives de SM le Roi Mohammed VI Que DIEU l’assiste, des mesures préventives visant à enrayer la propagation du virus en vue de sauvegarder la santé des citoyens malgré les répercussions néfastes sur l’économie, telles : la fermeture des frontières, la création d’un fonds spécial pour confronter socialement et économiquement les retombées de l’épidémie,…etc. L’état d’urgence sanitaire a été déclaré et les gouverneurs doivent promulguer un dispositif permettant à gérer juridiquement cette situation brusque. Au milieu de cette crise, les professionnels de santé qui se trouvaient dans la première ligne de bataille ont manifesté une bravoure et un patriotisme sans précédent. Leur soutien, leur encouragement et leur protection semble un pari à ne pas perdre dans un système de santé fragile et désuet. Dans cet article, nous allons essayer de répondre à la question : comment était l’impact de l’état d’urgence sanitaire sur la production de la règle de droit ? Aussi, la législation en vigueur est-il suffisante pour protéger les professionnels de santé qui luttaient dans la première ligne contre le Coronavirus ? Une fois nous nous traitons tout ça, nous tracerons les grandes lignes des défis et des réformes nécessaires pour améliorer le système de santé.
